June 2011 Visa Bulletin Predictions - EB Category

Here is the prediction for June 2011 Visa Bulletin. We should see following movements in each category as long as USCIS/DOS would use visa numbers for each category as per statutory allocations.




Updated 10 May 2010 - (Check this for Reason of Update)

Predictions

  • EB3- China could advance to 01 July 2004

  • EB3-Philippines could advance to 22 September 2005. (As EB3-P cannot have cut-off date surpass that of EB3-ROW, predicted cut-off dates are revised)

  • EB3-Mexico could advance to 15 October 2004.

  • EB3-ROW could advance to 22 September 2005. (Due to unknown hidden demand as mentioned in above linked article, we have to revise our prediction for EB3-ROW from 1 Oct 2005 to 22 September 2005. Reduction in demand for May was only 1575)

  • EB2 will be current for ROW, Mexico and Philippines.

  • EB3-India could advance to 22 April 2002.
  • EB2-India would see movement till 15 July 2006 - Since I-485 Inventory suggested that demand for EB2-India from '08 May 06' to '01 July 2006' was 2806 and demand data only reduced by 2875, this suggests that not much upgrade demand was gauged. We still think DOS will be interested in gauging some more demand before moving dates in June visa bulletin by significant amount. We still predict that cut-off dates for EB2-I will move by two weeks and at most by 4-5 weeks. We expect significant movement for EB2-IC in July visa bulletin.

  • EB2-China could advance to 08 August 2006.

This is my opinion. EB2 India will move 6 to 7 weeks in June and July bulletin. So, In July bulletin the priority date would be 15th Oct 2006.

For E3P, it seems God is working for us. I will be very glad if one day, I will see on the VB that E3P is already processing 2006, that means, all of us with PD 2006 has a shorter time to wait.We are almost there........What is important is that the VB has a forward movement.Hope we will not see U althrought out.WE have waited for so long and lets pray that this U will not appear forever...God , please do some miracles for us your People who have been separated fr our love ones.Amen.

I can expect 4 weeks movement as a best case but not more than that. Reason being that DOS would not have gauged any upgrade demand by 1st week of May; which is really what DOS is worried about. So if they had to move dates by 6-7 weeks in June bulletin to gauge demand they would have done this in May visa bulletin. My gut feeling is June is going to be a quiet month. Yes we might see 12 week movement in July visa bulletin.

This is my opinion. EB2 India will move 6 to 7 weeks in June and July bulletin. So, In July bulletin the priority date would be 15th Oct 2006.

I expect you to be current in November 2011 - January 2012. After this month EB3-P may move only by 3 weeks for few months. I still need to crunch some more numbers.

@rinku You would have to wait one more if dates will move to 22 Apr 2002. All petitions before the published cut-off dates are considered current and allowed to file I-485.

Thank you. I want to update the calculator to add post CY 2010 data but am just waiting for new I-485 inventory to release. This way I do not have to repeat the efforts. My plan is to update calculator with each released inventory.

My priority dat is August 15 2005. I will be current in May. I would like to know, how long does it take to get my green card. My wife, son and me.?

Will it be a good idea to buy that airlines tickets, because they are cheap now, im planning to by for June 22?

Do you guys think government shutdown will happen?

It can take one month to 3-4 months to process your green card once it will become current. You can travel outside US but I will wait and see if they need your FP and Medical Examination again. I would also ask your friend to check your US mail regularly for any RFE or appointments during the time you out of country. Most important, please make sure AP is renewed and is valid through out your trip outside US.

My personal opinion, if it is not an emergency trip, postpone it until you will get green card. Regards.

Chances are 50 % for June visa bulletin. If you will be current this June, you may get your GC anytime from 15 days to 2 months depending upon what documents does USCIS need to process your GC. Examples: FP. Medical Examination, other documents.

I would say anywhere in FY 2013 and FY 2014. FY 2014 would be a stretch. It depends on two things, a) EB3 to EB2 porting and b) How USCIS/DOS would plan to handle PD movement post July 2007.

There is possibilty that they will ask again. Most of the people who had file in 2007 had FP redone in 2009. If your was not done, chances are they might ask. But again nothing is concrete.

@shruti Though Calculator suggests 6 years but I am assuming that every year atleast 2000 people with PD before yours will port to EB2. In this case you can get your green card as early as 3.5 years.

Hello CM, when can you update your green card calculator? This site of yours had been a blessing to us with pending PD'S. I had a friend whose PD is March 1, 2009 EB3Phil. According to the calculator she will have to wait around 6.5years. Is this accurate or the time will reduce coz it started counting January 2010, and now we will be nearing May 2010 plus the porting from EB3 TO EB2.Thank you for this site again. BTW a top cop in alaska is an illegal immigrant hehehe.

We are in process of updating our green card calculator to add new PERM data until Q1 FY 2011, to account for Porting as per current trend that we see for each country and category, to account for spillover for each country and category based on current trend and if possible to predict green card wait time from the current date. We hope that new I-485 inventory will be updated whilst we are in this process.

As of now all estimation is from 05 January 2011.

How do you think a person with h4 visa who is employed by using other's identity? Don't know how he got a name with ss number.Wanting to help his family,can't blame him, waiting for so many years on h4 visa and letting days pass by without doing anything and just watching the spouse hardly working to feed the family is a torture.How about a part time job 3 hours a day on 2 days a week on h4 visa, is it just ok? I prefer for the latter because the former is heavy. Is there a proposed bill that h4 visa holder can be employed if being approved?

If you have filed your case as Consular Processing, you can have your interview around April 2013.

Do not involve in latter or former, individual can be deported or imprisoned for any such options. If H1B visa holder cannot support their dependents, they should not be in US. H1B by law requires to submit affidavit of support before sponsoring H4 visa.

If it is important for h4 visa holder to earn money, there are others option he/she can choose.

a) Enroll in a graduate program that offers assistantantship (RA/TA). Dependents can talk to professor and work voluntarily for at least one semester to prove her/his merit before getting enrolled in a program.
b) Find a work which sponsors H1B visa
c) Look for job in non-profit organization which does H1B Exempt visa.

Yes this is a good news. At least someone is looking at your file. But this is a very common procedure where cases at national benefits center are transferred back to service center just before being current so that they can be processed if complete in all respect and thus can be counted towards utilized or used visa numbers. I will keep my fingers crossed. Good Luck.

Chances are very slim. I would say around 20%. In best scenario,dates will progress to date same as EB2-C, which will be 08 Aug 2006 in June visa bulletin.

Hello CM! My petition was approved and got case complete and documentary qualified before I got pregnant, and now my daughter is turning 2 yrs old this April 30,2011. What shall I do I wanna bring her together with me and my husband. But I haven't informed the NVC about it yet. MY PD is Sept, 2005 and is about to be current. What documents do I need to prepare for her and is it possible to put her as accompany me to the US now in my DS forms? Another thing, do I need to fill up a separate DS forms for her too just like with my husband? Your best advice is highly appreciated. I'm so worried about her to be place in FTJ. Thank you so much CM!

We are on the same scenario. My PD is December 2005 (EB3-P) and supposed to be documentarily qualified on November 2010 but due to including my baby who will be 2 years old this coming July, my case status moved backward by one step (NVC received your checklist letter response on…please wait 4 to 8 weeks…).
Two months ago I sent an email and at the same time called NVC regarding my child and they advised me to send her filled DS230, birth certificate and to pay the visa fee which I did.
Regarding on how to pay the visa fee, you will have to pay it thru a lawyer that will be assigned to you by NVC. Instruction will be provided by NVC regarding this matter.
I am also expecting that my PD will be current within 2-4 months and hope that by then…I will be documentarily qualified...again.
My advice is to send an email to NVC or call them C and inquire about your status.

@Hopeful_usrn I would apply for your child as soon as possible whenever your PD will become current. Since he/she is turning 2 year old you have to file a FTJ application after you receive green card. I would submit DS forms as soon as possible and also try to file your child I-485 if possible as soon as when date will become current.

You could be current somewhere around December 2012. Yes since you are outside US your case will be handled by consular processing.

Yes there should not be any problem. He can hold as many PRs from different countries as possible. He would not abandon his application here.

Sorry but it pisses me off the India and China oversubscribe and cause us from the ROW to be on the eternal wait list too. I don't see why spillover from EB1 should automatically go to oversubscribed countries, give people from the rest of the world a chance!

We are on the same boat, eb3 phil with PD july 2008. Using the calculator of this wonderful website, we have to wait for 4 years and 11 months more, and my son will also turn 21 on january 2013.The only way I know for him not to be out of status is to apply for a student visa, I also dont know if he will be covered by Child Status Protection Act (CSPA)since we only have approved I-140 and didn't filed I-485 concurrently due to retrogression, but i'm still hoping for the best.

Unfortunately, as per our current calculations, you will not be current until Jan 2016. I would really start looking into possibility of finding EB2 job if possible before she turns 21, so that you can file I-485 and lock her age as per CSPA rule before she turns 21.

@vj I will think in first quarter of FY 2013. We do not expect July 2007 backlog to be cleared until FY 2012. Once it is cleared, DOS would move dates by 4-5 months. You will be current then.

I assume your case is CP. You have to file I-824 - "Follow to Join" immediately for him so that they can interlink your case to his. Please fill all the required DS Forms and send it to NVC as soon as possible. This way he will be added to your case. You cannot show up with your husband on interview like that. You have to wait now again until he becomes documentarily qualified.

You could be on borderline for this year. It totally depends on what is EB2 - ROW demand for FY 2011 and the numbers that Mr. Oppenheim suggested were half-yearly or projected yearly. Based on these you could very well be on borderline. Other than this PWMB numbers starts to increase after March 2007 PD dates. Lets touch base again after July visa bulletin. Good Luck.

Porting is legal and allows individuals to enhance their career as and when opportunity comes, especially when countries oversubscribe and retrogress.

Chances are 70-30. You will be current in July bulletin for sure. If you are one of those who didn't file during July 2007, I would add at least 6-7 months for gc to be approved, if you will file at TSC or 4 months, if you will file at NSC.

It will be slow because density of application is high each month from October 2005 onwards. When I am saying high it means movement will be around 3 weeks per bulletin rather than 5 weeks as we will see this month. In some months it will be just 2 weeks.

Yes you may be right that most of the people who port are trying to get GC earlier, but moving to EB2 also entitles them to better job which means better pay. So both things go hand in hand. With change in spillover I do not blame these EB3 folks to start looking into this option. EB3 is a black hole now, especially for Indians. Who wants to stay in this limbo if they have an option. Now it is mostly EB3-I folks but soon within a year it will be other country's as well. USCIS will never stop porting because this will get them money twice from an applicant. But you never know with USCIS. If they are smart enough they would analyze and see whether annual EAD/AP renewal gets them more money in long run or porting. You know what I am saying.

Big jump in March bulletin was because density of applicants was less in those months. On an average they use 1500-2000 visas per month. We can expect big jump again in August bulletin if DOS felt that CP demand is not converting into real demand to consume yearly allocation of 28,800 visas.

I do not know if you are current as per June visa bulletin but in case you are, you can call and talk to official in NVC but I do not think they will make any exceptions. In case your visa screen will expire, you may have to get it renewed. This will prolong your waiting time.

I guess you mean EB3 other workers. Issue with EW workers is that it only has 10,000 total visa per year and they have to allotted on basis of PD for EB3 skiled professional category. You would usually see more decent advancement in these categories during last quarter of fiscal year.

Hi CM, I am on H4 and got an admission in a university for MBA. I have already applied for COS from H4 to F1 and its pending at California Processing Center. My husband who is on H1B and his I-140 already cleared. We think his priority date will be current soon (oct 27, 2006 EB2 India). I have following questions

1) If the priority date becomes current and my F1 is not approved can I withdraw the COS application and apply for I-485 ?
2) How much time does it take to withdraw COS to F1 ?
3) If F1 is approved then can I immediately apply for I-485 or do I need to wait for sometime ?
4) If F1 is approved then do I need to get it stamped before I apply for I-485 ?

Please see answer to your question below.

1) If the priority date becomes current and my F1 is not approved can I withdraw the COS application and apply for I-485 ?

A- No matter what, I would withdraw your F1 application as soon as possible. Reason being F1 is not a dual-intent non-immigrant visa which means you cannot pursue permanent residence or immigrant intent while being on F1. Since you are changing to F1 status right now, you are vouching for non-immigrant intent for at least few months or year. So if your F1B visa is approved and then you file for I-485 immediately there is a conflict of interest. In that case visa officer could pursue cancellation of your F1 visa which puts you out of status and hence abandons your AOS if it will be filed. Immigrant intent can be different from immigrant desire, which is allowed on F1. Here Immigrant desire means individual came to US or changed status to F1, pursued school for a year or two and then desired to change his status to work on H1B or file LPR.

INA act requires F-1 visa applicant possesses a permanent residence in a foreign country he or she has no intention of abandoning "residence abroad". Non-Immigrant intent became a requirement for all nonimmigrant visas, except ones like H-1 and L, which no longer have, or never had, the "residence abroad" requirement.

The US immigration law does not prohibit F-1 status holders from changing their mind and deciding to pursue permanent residency once they arrive in the US . As a matter of fact, I-485 was systematically set up as a legal conduit for non-immigrants to change their status to permanent residents.

A related issue to the change of intent is preconceived intent or visa fraud. As a general rule, a person cannot have preconceived intent to enter the U.S. for a purpose different from that permitted under his/her visa. The courts have held that an alien may not enter as nonimmigrant or change to status of F1B in bad faith. The USCIS holds the opinion that F-1 students are deportable if they enter the U.S. with a preconceived intent to seek permanent resident status. If an alien files an immigration petition or applies to adjust to LPR status from a nonimmigrant status immediately after making the entry into the US, the USCIS would likely find that the alien entered with a "preconceived intent" to remain and that the F-1 visa was fraudulently obtained. The USCIS and the Board of Immigration Appeals can, as a proper exercise of discretion, deny the alien's adjustment application and deport him. The theory is that the alien would have never been admitted to the U.S. had he not misrepresented his intentions, so he was excludable at entry.




2) How much time does it take to withdraw COS to F1 ?
A- After submitting I-539 to USCIS and asking your school to cancel your I-20, it will take atleast a month. You should call USCIS and talk to rep their asking procedure to expedite your application.


3) If F1 is approved then can I immediately apply for I-485 or do I need to wait for sometime ?
A- You have to wait at least for few months before you will apply. I would consult good lawyer. It is on discretion of visa officer. Take legal help.

4) If F1 is approved then do I need to get it stamped before I apply for I-485 ?
Please do not leave country. Mostly like your F1B stamping will not be approved if during interview they will ask or check about your husband's immigrant intent.

Please seek legal advice on this issue as it is very sensitive and is surrounded by lot of gray areas. Best case will be you withdraw your F1B COS application.

It similar to the letter that is sent for COS. Over there you will mention that you have decided not to pursue due to unforeseen personal reason. First step that you should take is ask your university to cancel your I-20 with SEVIS.

@Hopeful_usrn Since new owner has acquired old owner, but job and location is still same, new company can file I-140 amendment to change name on the petition. Since AC21 portability does not apply in a CP cases as AOS is not filed, you cannot switch jobs or different employer otherwise.

Unfortunately, as per our current calculations, you will not be current until Jan 2016. I would really start looking into possibility of finding EB2 job if possible before she turns 21, so that you can file I-485 and lock her age as per CSPA rule before she turns 21.

Are you talking about filing I-140 in premium processing? If so once that is done and if your is a CP case then on approval of I-140, you will receive Packet 3 from NVC and on submitting all documents and getting documentarily qualified, you can expect interview in month or two time. This whole process from I-140 approval to NVC sending packet to you getting documentarily qualified can take 8-12 months.
