EB3 Category - People Who Missed the Boat (PWMB)

In lieu of updating our green calculator we have completed our analysis on "People Who Missed the Boat" (PWMB) during July 2007 fiasco for EB3 category. It may be too early to see effect of these in current visa bulletin but as dates will move into 2007 these numbers can be significant. On average if your PD is after July 2007 assume 6 more months wait for EB3-ROW, Mexico and China , 3 months for EB3-Philippines and atleast a year for EB3-India. PWMB for EB3-ROW and Philippines is calculated from 01 March 2006, latest PD that was currentafter July 2007, whereas for other countires it is calculated from first available petition.


PWMB for EB3-India and China were published previously but are added here again for reference. PWMB for EB3 category for most countries means they will consume significant visa when PD will reach year 2007.

Great work on this analysis. Based on my understanding from what you're saying here. Will movements significantly slow for EB3 ROW once it hits 2007. Also i'm not quite understanding your analysis here:

Are you saying these are waiting times to be current in order to file 485?

ok my PD is july 2007. my bisa expires nov 1 2011. what does this mean for me? is my pd coming sooner than expected(2014)? i really appreciate your articles and responses!

Sorry for being ambiguous in my statement. When I said 6 more months wait time for EB3-ROW, I meant adding this time to number of years that is predicted by our green card calculator. For e.g. 13565 - PWMB for ROW means 13565/2000 = 6.8 months additional wait assuming only 2000 out of 2400 visa numbers are used for clearing USCIS inventory every month and other 400 for remaining 15% cases that are from CP and other local offices.

No this means your PD will be current 3 months later than expected assuming you are EB3-P.

***Hello CM*** before I ask you my question, "THANK YOU" your efforts are much appreciated while I anxiously await to be reunited with my family. I am EB3-ROW PD OCT 2007, do you in your opinion think I will have my Green card issued before August 2013? My child will be 21 in Nov 2012, i have been told past that date she has 9 months (the time it took for me to be approved) in order to qualify with me. Thank you again, i look forward to your reply.

I think October 2013 will be difficult. January 2014 looks more optimistic. I understand since your I-485 is not filed, CSPA will not be able to protect your child. I really hope that this part of reuniting family act need fairer attention as soon as possible.

I sure hope in this case your prediction is incorrect, I cant belive that my daughter will not be included for the sake of a few months, I started this process when she was only 14 years old!!! Is there any exceptions here?

I really hope that this will not be the case. Matter of fact there are chances that you may be current before that and your daughter's I-485 might squeeze in June-July 2012 and thus her age will be locked. I see same thing happening with EB3-ROW that is currently happening with EB2-IC now when their PD is so close to July 2007. Dates will advance more near July 2007 and then retrogress. Calculated January 2014 is after considering PWMB's but in reality DOS will not see this demand unless dates will cross July 2007 and near PD July 2007 dates may progress more than required and then retrogress.

Hi CM, taking on board what you say, does this mean that IF in fact we can file I-485 Jun Jul 2012, which would be awesome, at that point are we able to return to the usa? then await green card once we are there? Thanks for taking the time to look at this, keep up the good work, we do appreciate it.

if yours is CP case then you can only enter after approval of i-485

You should be current anywhere in 3 years.
