October 2011 Visa Bulletin Predictions - EB Category

October Visa Bulletin will be the first bulletin for FY 2012. As with every October visa bulletin for new fiscal year, retrogression can never be discounted. Here is the prediction for October 2011 Visa Bulletin. We should see following movements in each category as long as USCIS/DOS would use visa numbers for each category as per statutory allocations.

Though this beyond our scope but the picture is showing Plant X or brown dwarf called Nibiru or Eris, which some believe is approacing Earth in 2012. NASA commneted on this as being internal hoax.

Hi CM,

Thank you for all you efforts on this blog. I discovered it recently and really like it. I had a question. My PD is Jan 2008 EB2I. There is little hope of it being current anytime soon. If I travel to India and my visa gets rejected or if I permanently move to India. What are my options when my PD becomes current (after moving). My I140 is approved.

Retrogression seems unlikely since the demand after mid August 2007 is negligible for year 2007. Most likely the ones in the pending inventory would be pre-adudicated cases.

Retrogression will only happen for October month if by September visa available for EB2-IC are exhausted and pending PWMBs are more than 500-700. But if that will happen if will progress again in November-December 2012. Based on past year experience, DOS would rather use the full annual allocation early if lot of porting or PWMBs are seen rather than retrogresing.

Known demand after 2007 is negligible but there are thousands of applicants with PD 2007 still waiting to file I-485, which cant take majority of the spillover for FY 2012.

You can opt for Consular Procssing at consulate at your home country. In order to do this your sponsoring employeer should still be willing to provide a valid job offer letter with duties mentioned same as in PERM application.

Hi CM - My PD is EB3I Jan 2009 with old employer and currently working with new company on EAD. The current company is ready to file new application in EB2 category. Do you suggest porting or wait it out? Thanks.

So Hurricane Irene is long gone and we are back up and running.

Here is the information on quick chat that I had with our lawyer friend. As per his info - “EB2-IC with PD post December 2006, who are still not pre-adjudicated or our PWMBs should expect less approval for this fiscal Year. Most of the visa numbers available are close to be exhausted by EB1/EB2-ROW, EB3 approvals, and other remaining is expected to be used by EB2-IC strictly based on Priority Date. Any recent porting cases with old PD will see quick approvals and PD upto December 2006 will see approvals in order of PD depending upon visa numbers available. USCIS is currently working to inform DOS on prorated number of visas request that can be used and total demand post December 2006 that still needs to be catered. Based on available numbers, October VB will stay put or retrogress. Goal for USCIS is reduce oldest EB2-IC backlog as much as possible"

CM- The information presented here in should be taken at your own discretion. I have no other way of rationalizing this. Time will tell. Lately, his information has been pretty accurate. Good Luck.

According to this report from USCIS

There are total of 26,993 140 approvals for the period starting Jan 1 2008 to Jun 30 2011.

Based on this will we see current in visa bulletin very soon ?

Thank you for posting this data. It seems too good to be true. Thing that is throwing me off from it is a "Quarterly Report" that is listed at the bottom of the report and my personal hunch tells me that this is the statistical data for I-140s that were approved in Q3 FY 2011 for those filed in different calendar year.

If you will compare this with the http://dashboard.uscis.gov/index.cfm?formtype=7&office=5&charttype=1 with dashboard data for I-140 on number of total completions of I-140 data for last 3 months = 9348 + 9307+ 8073 = 29839, number comes very close to those reported in above report.

So I would say do not get carried away with the published data. It is a quareterly report with approvals from the petition filed during different calendar year from 2008-2011.

Hi CM,
My EB2I PD is june 2010 and i know it will take a while for my PD to become current. I am applying for my H1 extension and my project is also getting over soon.
If i dont get extension and change my status to L2 in that case Will my approved i-140 be valid and am able to file I-485 when my PD become current?

I have to think about my options and dont want to loose my GC process.

I would really appreciate you reply.

This quarterly report shows Immigrant Petition for Alien Worker performance data for consular-processed I-140s and does not include any associated dependents. The number of cases approved are displayed by class and beneficiary country of birth.

It totally depend upon demand data that will be reeled for this bulletin if it is any more than 4800 then you will need to wait for few months.

We have not done any calculation on FB category yet hence no predictions, we aretsegeting march 2012 to add analysis w.r.t. Family based category. As of now we are collecting data.

Yes your I140 will still be valid. All you need to have is valid job offer on day of approval of GC.

Could you explain how it moved 3 motnhs since EB2 hasonly 2800 for entire year and demand is 5000+3000 PMW .I would apprecite your comments.

So they are planning to move the dates slowely... Not waiting for year end!!!

EB2I PD is moved by 3 months but demand data for oct is showing same count as sept. its really surprising to see this movement where demand data remains same. any thoghts on this?

Hi CM,

I need your suggestion. My priority date is Sept 2007. I was under the assumption that it will be 2012 before I will be current and hence planned to go to India in October for 4 weeks and get my H1B stamping done. I am full time employer and hence assumed low risk for my stamping

In the light of this new movement I am in a dilemma. Do you think I might be current in the next couple of months this year?

Any suggestions are really appreciated.

Interview are rare and may only apply in complicated cases. With PD of April 16th 2007, you should be approved in month of October.

It will be current same time no matter AOS or CP but you may expect GC soon as long as you are documetarlly qualified then.

December 2008 may take 2.6 years from today.

My PD April 30 2007 and is current for October bulliton. I am in EB2.
(1) Could you please let me know how many days it will take to get the green card? I do not have any criminal records and working for the same company who applied my GC.
(2) If the employee fire me in next month is there any thereat to my GC?
I am feeling tension and could not able to do any work for the past 4 days. Please let me know what will happen in this scenario.

It all depends upon visa number availability. You may get green card in October. In case you lose job before your GC approval and USCIS will not ask for Employment Verification Letter again, you may get your green card but could (not) run into issue during naturalization. In case you will be let go before approval please try to get similar job on approval and work for few days. .

If you will opt for CP case then you will receive Visa Bill from NVC to pay fees atleast 8-9 months before which they think your PD will be current. Once you wil receive visa bill for NVC and you will pay that, you cna expect Packet 3 from them where you will be asked to submit DS-230 with all the required documents. Once NVC will receive all the documents and is satisfied with it, they will mark you "documentarily qualified" and now you will be part of demand data. Once your data will be current and at that time your are "documentarily qualified", then only you will be called for Consular Interview to receive GC> From fay you receive Visa Bill to day you are documentarily qualified, it can take 8-12 months.

Around 1.5 years from today if you are EB2. If you are EB3, it will be at least decade. If possible I will port to EB2 after attaining few years of experience.

3 year degree is always a concern wrt EB2 approval but there are many cases approved for EB2 with 3 year degree. Getting PERM also depends upon job requirements and not only on what experience you have. If job is EB2 qualified you should be fine.

As long as your I-485 case is pending before sone turns 21, you should be fine. If not then he will have to go through his own petition EB or FB based. Time when your I-140 is pending can be removed from your son's total age. E.g. Case pending for 6 months allows you to minus 6 months from you son's age for I485 purposes. So if it make sense file your new I140 via regular than PP as it may take a year from today before your case is current. Whenever your case become current you can change it to PP. Talk to lawyer about this.

Iam so encouraged to write here since I can see that you answer real fast.
Myhusband has applied the GC through a parent company and the PD is Sep 2007 (EB2). Once the project through the parent company ended, it was real difficult for him to find a job on a corp- corp basic and he is now working as a contractual with the EAD from my G4 visa. Since the PD had progressed, he is trying back to get a corp-corp project. Is this going to affect GC processing in any way? Please advise.

Yes when he will file for I-485 based on his PD he will need to submit employment verification letter saying a full-time job is available to him with aforementioned job duties and salary. Job has to be on full-time basis from a company although he might work on corp-corp basis for client. I will suggest that before he submit for his AOS, he should secure such job.

Hello CM,
I just want to know something from you about my friend's situation.She has an approved I-14o and she is on the last year of her H1B 6 year limit. Since her PD is not yet current, she filed I-129 for her extension of stay 6 months before her visa expires but the processing was delayed due to RFE.She responded for the RFE and the uscis received it less than 2 months before her visa expires. My questions are: will she be considered out of status if her visa expires before she will receive the final decision? When her PD becomes current and will file I-485, will she have trouble about this lapsed time between her visa expiration and receiving of her visa extension?

It is just matter of time before you will receive approval. Once approved you should work for your sponsored employer for some time. There is no risk with changing jobs at this time as long it is before approval and you can make sure AC21 and new EVL is submitted before approval. Personally I will pass on this opportunity now due to added complications.

Once case is filed before visa expiry she is in legal status. No problem with lapsed time as her approval will have dates from her visa expiration date.
