Here is the prediction for August 2011 Visa Bulletin. We should see following movements in each category as long as USCIS/DOS would use visa numbers for each category as per statutory allocations and as long as EB2-India and China will continue to receive spillover as per INA Section 202(a)(5).

So how are we to know if we still have the visa numbers available from EB1 and 5?
Mine is on July 1st 2007,any chances of moving the date to July 8th 07. do we know how many pending cases for that one week?.

Question-In the page where I can enter the chargebility, country and PD to see when I can get my GC, the result I get shows around 5 yrs. Does this mean 5 yrs from PD or 5 yrs from today?

Any spillover number that is more than assumed will cause dates to move ahead. August visa bulletin will be really used to get most of the spillover consumed and movement in September bulletin will only be for the remaining spillover to consume CP demand and get some inventory for next year.

We do not expect to receive any spillover from EB4 for this fiscal year. EB5 can yield 8000 at most, this was used when 11,000 were used for movement in last bulletin (8000 from EB5 and remaining 3000 from 12k EB1). In reality, last month's bulletin movement was observed after taking 11,000 numbers from each EB1,EB5 and EB2-ROW category, but for simplicity let's assume numbers came purely from EB5. Hence no more visas considered from EB5.

Number we assumed in the prediction is bare minimum, Anything more means more movement. But we should assume whatever the number is available for rest of the year, most of it will be used for September visa bulletin (80%). If number would clear entire pre-adjudicated or documentarily qualified backlog, then in September bulletin, DOS can use numbers to capture known EB2 -IC CP demand based on documentarily qualified applicants (satisfying this demand will also bring in new AOS application and hence inventory) or use it for EB3 category.

If numbers left for the rest of the fiscal year is 2x than required to clear backlog or pre-adjudicated cases (July 07), then EB2-IC August VB will get maximum mileage as DOS want and then in September bulletin DOS can use numbers to approve as many cases still dq but not approved and remaining number will go to EB3-ROW.

I read another blog online today. It say USCIS won't request a visa number from DoS before 485 approval.

So does that mean the spillover size might be bigger? And some of the EB1 and EB2ROW applications will not be able to use the visa quota of current fiscal year?

If this is the case, then my follow up question is:
Since the current cutoff date for EB2IC is 03/08/2007, many applicant who can start to file 485 before the cutoff date will not be able to use the visa quota of current fiscal year if their 485 won't be approved before Oct. 1. Therefore more people will be able to file 485 with a bigger advancement. The more advancement this year will mean a longer waiting time next fiscal year because more and more approval of 485 after Oct. 1 has to use next year's visa quota even the AOS is filed before Oct. 1 this year.

I am not sure whether I made myself clear. In a word, if the advance date move into Q1 of 2008 on your analysis of July VB. USCIS won't be able to process huge number of 485 filing before Oct. 1, and these applicants have to wait for the visa quote of next fiscal year and it will be even longer waiting. Just like many poeple filed in July 2007 cannot get GC until the date become current again this year assuming their 485 already approved.

Or once the DOS gives the spillover quota to USCIS for EB2IC, each applicant who is going to file 485 shortly will get an assigned visa number already?

Please help me understand and correct me if I am asking stupid questions.

Just wondering whether you have updated numbers of PWMB in class EB2IC and how that would affect the EB2IC in the next few months and beginning of next fiscal year. My priority date is Sep 2007 EB2C and concerned about retrogression again from Oct VB.

In CP cases it is important that employer is available. If they are not communicating, you can take a chance and go to interview. I am not sure if new employer will work for CP cases because AC21 is not applicable. Consult lawyer.

My priority date is Mar 12 2007 EB2 India. I have a dependent who has not filed for her EAD/AP. Could I jump the gun and file her EAD/AP on July 1st itself without waiting for the Aug bulletin. Would USCIS reject her application right away ? Any historical precedents on such cases ??

Let me know what you think: "There were number of pressing issues going on at the time which demanded my attention leading up to the determination of the July dates. The posting of the employment demand is done strictly as a courtesy to the individuals who have an intrerest in that type od data.Had I taken time to update it last week that would have caused a delay in the determination /posting of the July dates. It will be published when the August dates are announced in early July.Further movement will be dependent upon the demand patterns between now and early July,and consultations with USCIS."

Great post EB2C....very informative. Most interesting part about the post is that how VO is talking about not publishing demand data for July 2011 Visa Bulletin that could have caused major delay in the publishing VB. This tells us that Spillover remaining for the current year is way more than used in July VB and VO was not worried about demand data, as unused visa numbers were more than enough to cover demand data for EB2-IC to move dates to 08Mar07. This suggests some good movement expected in next two bulletins.

"It will be published when the August dates are announced in early July.Further movement will be dependent upon the demand patterns between now and early July,and consultations with USCIS."

Now interesting part about statement quoted above is about consulting with USCIS apart from noting demand pattern. This suggests that now DOS will consult with USCIS ans ask them what they can handle before making big jumps. Now it is all speculative how USCIS/DOS will handle it; move dates far beyond PD July 2007 for EB2-IC or use USCIS judgement to stop the movement and concentrate on EB3 category. We should not forget that moving dates beyond PD July 2007 for Eb2-IC means more work for USCIS: new I-485, EAD/AP, FP notices; whereas if dates will be moved for EB3-ROW all they have to worry about is approving pre-adjudicated cases.

I really doubt that EB3=P will be June-July 2006 even if EB3 category will receive spillover it will be used towards EB3-ROW backlog and not EB3-P.

I heard from one of my friend, he got the GC card. The trciky part is this. His proirity date is 10th Feb 2007. He is also confused how he got it. AS the current month date is only upto Oct15th 2006. Only next month first it moves to March 8th 2007. He was preparing heavily for writing to Senator and planning for infopass etc etc.

Is it possible? did it ever happen? He is far from me otherwise i would have gone to his home to check the GC myself and other paper work .. haha..

I am opting for AOS and my company lawyer mentioned it's a good idea to get the documents ready to file in August.. we already did the medicals..are we on the right track or is it too much to hope for this year? your thoughts..

Retrogression will be caused only if rapid movement of PD will cause incoming new I-485 inventory to be greater than 2803 (annual quota of EB2-IC each). Even movement of PD from July 2007 to September 2007 will cause more than these numbers. If dates will progress to first quarter of 2008 to accommodate CP demand in FY 2011, this in turn will bring 20k or more application to I-485 AOS inventory. Any number greater than 2803 will cause dates to retrogress until the PD where there are only 2803 applicants.

What all documents do I need to be prepared with if I get my date current for filing the I485? My PD is Apr 10, 2008, so I might be getting the date current by Aug 2011 (based on some of your predictions if date moves to 1st qtr 2008)....So most of the educational documents and professional documents are already filed...My understanding is the following new documents would be needed:
- Birth certificate
- Tax return for last 3 years
- Immunization card for the vaccinations in India...

Is there anything else that might be needed?

Your analysis is excellent as always. I believe your guess is correct regarding USCIS leaning towards stop the movement beyond July 2007 and concentrate on EB3 category. That will atleast ensure that visa nos are not wasted for eb category. Even if they move dates beyond July 2007 there is no way the new applications can be processed and allotted the visa nos.

However 2 questions still remain for me. Firstly,assuming if DOS does not move the dates beyond July 2007( assuming that all the cases till July 2007 get cleared this fiscal year), how will they build the inventory or estimate demand for next year? Secondly, will the generation of revenue for USCIS(by allowing new applicants) by moving the dates has any impact on their decision making? Your take on this will be very helpful.

I read on some blog that the spillover from EB2 category cannot be used for EB3 or category unless EB2 is current. Please confirm if that is correct. If yes, then do you think DOS might consider making EB2 current for a month and retrogress later so that they can use the unused spillover nos in EB2 category towards preadjudicated cases in EB3? I know this is just a wishful thinking but wanted to know your opinion. I understand that the unused visa nos will not go waste in anycase as they will be used for FB next year.

I hope USCIS/DoS will apply all the spillover to EB2 by law. I think they can not apply to EB3 unless the demand of EB2 are satisfied. But who knows about the bureaucracy.

In case of pre-adjucicated applications (I-485's), when PD becomes current - is there any expiration time on the application components? Like FP, medical, etc. What I mean to ask is I've filed during 2007 fiasco, no (hopefully soon) my PD will be current, but there is 4 year gap from the time of filing. What documents USCIS will ask (if any) to re-submit? Perhaps I can start this process right now, for instance medical, to have it on hand when they will ask for it again?

Breaking News:

Some Indians are getting NVC fee notices with PD of June 2008.

Just as what I analyzed yesterday:

1. NVC sent fee notices to PD of 2007 after VB release in April
2. NVC sent fee notices to PD of April 2008 after VB release in May
3. NVC are sending fee notices to PD of June 2008 after VB release in June

It's just like what I predicted. DOS updates NVC on a monthly basis. I think
the spillover is much more than their originial estimation. We are going to
see significant movement in this summer.

I also agree on this. If one has questions about the time they will get current, it is request to please use GC calculator and not post on this section.
Just my 2 cents...These people have their 140 cleared and are yet to file 485. They opted for Consular processing while filing their 140 rather than I-485adjustment of status (AOS).Since they are being Consular Processed, no I-485 is necessary, nor will be filed (unless they choose to convert to AOS). People who choose consular processing over AOS, their files are send to National Visa Center (NVC).

In the past, the NVC would typically send out the free notices a few months before the priority date is current. However, just because the NVC has sent these notices does not mean that visas are available soon. A visa can only be issued if the priority date is current. One has to reply to the fee notices within a year or they will terminate the cases, if people don’t respond.

I believe the quota of visa numbers for Schedule A nurses has been exhausted way back in 2008. Any pending Schedule A case for a registered nurse (or derivative family member) nows falls under the general employment-based third preference (EB3) category. I know there is one bill still pending in House to re-allott such provision again but no good news so far. As of nwo you will come under EB3-P. You getting current this year is slim possibility but not impossible if DOS will make dates current. For GC estimation use our calculator.

Even if dates will not move beyond July 2007 , USCIS will get enough PWMB application that they can use up entire annual quota and still with no need to progress dates. In this DOS will do waht they did this year, move dates way before last quarter. In thsi case in Q2 around February-March 2012. Even in January 2012.. Dates can be progressed by 6 months and this can generate enough demand to consume spillover for next year.

DOS decision is never based on USCIS revenue generation as we all know they dont even see a dime of the application fee. Concerning USCIS, logically speaking all they have to do is wait for 6 more months to generate revenue after DOS will move dates in Q2. USCIS is already too backlogged with EB1 and EB2-ROW cases. IMHO, they are not in position to increase the backlog any more.

MR : Rule is that if there is no qualified imigrant in one category then unused visa numbers can fall down to next eligible category with qualified immigrants. In this case qualified immigants means applicants that are documentarily qualified to receive green card and eligible to use visa. Technically speaking when category does not have qualified immigrant demand, it should be current. So what to say is right before they can use unused visa numbers for EB3 category, they should make dates current. This is the reason that we have always kept our stand that there are chances that EB2-IC will get current. if DOS will play by book then they have to keep EB2-IC current for this fiscal year until September and then plan to use available unused visa numbers to approve pre-adjudicated EB3 category.

Usually you should receive FR notice after every 3 years. If you have not then you might get one on being current. As per recent memo, USCIS is working towards not re-issuiong such notices for FP again and might approve most cases once it will get current. No medical exam is needed unless first one had any anomaly.

I have nothing more to add then what this gentleman has added over here. NVC visa receipt are on basis of projected demand that they think can be realised in few months. usually 8-9 months before PD getting current. But in case of EB2-IC it can be less than that period because of low CP demand for this category. Here NVC is doing it's job or projecting demand for few months from current PD to get ready in case DOS will come back saying I ahve these unused visa numbers available and what can you use. This is nothing but same as your Manager knocking your door at end of each quarter saying that I have this xyz amount of money available to spend and you are expected to be ready with some kind of eligible project needs.

All I can say is that receipt of NVC visa bill by many applicants is nothing but portends good fortune in my opinion.

HI Cm. I want some clarifications regarding the FTJ process . I am from Philippines and me and my son are FTJ of my husband. We are waitng for our PD which is Oct 2006. Ysterday, I read an email from US Emb IV Section Manila re: links on IV Applictions.It stated there that all FTJ whose petitioner has adjusted their status in the US should submit the I 824 to NVC and that all the processing now / scheds, fees , will be done in NVC. Before, I knew, we will have a CP Processing here in Manila.. Is it a new ruling?

Hopefully it moves beyond Dec 2007 for EB2 I in September before moving in to retrogression so that there is enough demand captured by USCIS. By some predictions it might move very well in to first quarter of 2008 aswell ,which I think is wishful thinking, but above all the buzz , USCIS works in weird ways with lot of unpredictability. In my opinion , if it halts at Jul 07 , the spillover nos hopefully will suffice the demand and a gradual progression might occur going forward. ...I'm no expert , will wait our guru CM to weigh in .

I need you guidance; I’m working for company A, possibly, I’ll get an offer from Company B. Company A have filed my H1-B extension (after 6 year based on I-140 approval). H1-B extension is in pending status with RFE.
Can I transfer my H1-B to Company B?? Please answer this question because it'll be very important to know so that i can plan my next steps.

You can transfer your H1 to company B while the initial petition is still pending. You need to make sure that the transfer application is filed before you recieve the decision on RFE on the initial petition. It will be better if you ask your new empolyer to do premium processing so that you get the result quickly. I am also of opinion that your current employer should not withdraw the i-140 for all this to happen.

I am not an expert and please take this as my opinion and not legal advise. Consult your attorney before you make any decisions.

Dear CM: Please help me understand when eligible to file the 485 after the date becomes current.

Let's say Sep VB reaches my cutoff date (09/2007). When can I file 485 along with EAD, I have to wait until September 1st or I can file immediately in August after the VB released in early August?
