Here is the prediction for August 2011 Visa Bulletin. We should see following movements in each category as long as USCIS/DOS would use visa numbers for each category as per statutory allocations and as long as EB2-India and China will continue to receive spillover as per INA Section 202(a)(5).

Why password protected blog post?
Instead, ask user to register and sign-in to your website. Only registered users can view the post in detail.
Otherwise, in future, for each such post everyone has to email you to get the key. This email/key isn't a good user experience.
Email/key is quick process where password is emailed automatically as soon as email is received. NOT ALL posts will be password restricted. Monthly visa bulletin predictions will be. Predictions have always been criticized, it better be viewed by those who use them as a guideline. We are not perfect!!!

Can you elaborate why didn't you take spillover from EB4 and EB5 into account on the August VB prediction?

Number we assumed in the prediction is bare minimum, Anything more means more movement. But we should assume whatever the number is available for rest of the year, most of it will be used for September visa bulletin (80%). If number would clear entire pre-adjudicated or documentarily qualified backlog, then in September bulletin, DOS can use numbers to capture known EB2 -IC CP demand based on documentarily qualified applicants (satisfying this demand will also bring in new AOS application and hence inventory) or use it for EB3 category.
If numbers left for the rest of the fiscal year is 2x than required to clear backlog or pre-adjudicated cases (July 07), then EB2-IC August VB will get maximum mileage as DOS want and then in September bulletin DOS can use numbers to approve as many cases still dq but not approved and remaining number will go to EB3-ROW.
My Priority Date is July 28,2007 on EB2 INDIA. Do you think my Priority date will be current this Aug/Sept? Please advise....

I read another blog online today. It say USCIS won't request a visa number from DoS before 485 approval.
So does that mean the spillover size might be bigger? And some of the EB1 and EB2ROW applications will not be able to use the visa quota of current fiscal year?
If this is the case, then my follow up question is:
Since the current cutoff date for EB2IC is 03/08/2007, many applicant who can start to file 485 before the cutoff date will not be able to use the visa quota of current fiscal year if their 485 won't be approved before Oct. 1. Therefore more people will be able to file 485 with a bigger advancement. The more advancement this year will mean a longer waiting time next fiscal year because more and more approval of 485 after Oct. 1 has to use next year's visa quota even the AOS is filed before Oct. 1 this year.
I am not sure whether I made myself clear. In a word, if the advance date move into Q1 of 2008 on your analysis of July VB. USCIS won't be able to process huge number of 485 filing before Oct. 1, and these applicants have to wait for the visa quote of next fiscal year and it will be even longer waiting. Just like many poeple filed in July 2007 cannot get GC until the date become current again this year assuming their 485 already approved.
Or once the DOS gives the spillover quota to USCIS for EB2IC, each applicant who is going to file 485 shortly will get an assigned visa number already?
Please help me understand and correct me if I am asking stupid questions.

I"ve heard from a reliable source that says that according to the USCIS and immigration, by the end of this fiscal year in September, EB3 Phils will be June or July 2006. What can you say on this?

Now interesting part about statement quoted above is about consulting with USCIS apart from noting demand pattern. This suggests that now DOS will consult with USCIS ans ask them what they can handle before making big jumps. Now it is all speculative how USCIS/DOS will handle it; move dates far beyond PD July 2007 for EB2-IC or use USCIS judgement to stop the movement and concentrate on EB3 category. We should not forget that moving dates beyond PD July 2007 for Eb2-IC means more work for USCIS: new I-485, EAD/AP, FP notices; whereas if dates will be moved for EB3-ROW all they have to worry about is approving pre-adjudicated cases.
EB3-P November 2007 will not be current for next 2 years.
I heard from one of my friend, he got the GC card. The trciky part is this. His proirity date is 10th Feb 2007. He is also confused how he got it. AS the current month date is only upto Oct15th 2006. Only next month first it moves to March 8th 2007. He was preparing heavily for writing to Senator and planning for infopass etc etc.
Is it possible? did it ever happen? He is far from me otherwise i would have gone to his home to check the GC myself and other paper work .. haha..

I know it's hard to predict with accuracy, but what's your best guess about EB3 ROW, PD date November, 2007 becoming currect?
October would mark new quota for all categories so October month bulletin should further move dates. But i read about retrogression in october bulletin expected. Why would that be when fresh year quota assigned in october?

Your previous VB (MAY thru July) predictions were always conservative. Is July 1st 2007 Eb2 I/C is also conservative or realistic or maximum allowed?
What all documents do I need to be prepared with if I get my date current for filing the I485? My PD is Apr 10, 2008, so I might be getting the date current by Aug 2011 (based on some of your predictions if date moves to 1st qtr 2008)....So most of the educational documents and professional documents are already filed...My understanding is the following new documents would be needed:
- Birth certificate
- Tax return for last 3 years
- Immunization card for the vaccinations in India...
Is there anything else that might be needed?

What about those EB3 from Philippines with special designation as schedule A nurses under I140 with Sept. 2007 as priority date for example, what can you predict on this? I believe this category of EB3 is different from what you are mentioning on EB3 P and ROW.

Your analysis is excellent as always. I believe your guess is correct regarding USCIS leaning towards stop the movement beyond July 2007 and concentrate on EB3 category. That will atleast ensure that visa nos are not wasted for eb category. Even if they move dates beyond July 2007 there is no way the new applications can be processed and allotted the visa nos.
However 2 questions still remain for me. Firstly,assuming if DOS does not move the dates beyond July 2007( assuming that all the cases till July 2007 get cleared this fiscal year), how will they build the inventory or estimate demand for next year? Secondly, will the generation of revenue for USCIS(by allowing new applicants) by moving the dates has any impact on their decision making? Your take on this will be very helpful.

I read on some blog that the spillover from EB2 category cannot be used for EB3 or category unless EB2 is current. Please confirm if that is correct. If yes, then do you think DOS might consider making EB2 current for a month and retrogress later so that they can use the unused spillover nos in EB2 category towards preadjudicated cases in EB3? I know this is just a wishful thinking but wanted to know your opinion. I understand that the unused visa nos will not go waste in anycase as they will be used for FB next year.

In case of pre-adjucicated applications (I-485's), when PD becomes current - is there any expiration time on the application components? Like FP, medical, etc. What I mean to ask is I've filed during 2007 fiasco, no (hopefully soon) my PD will be current, but there is 4 year gap from the time of filing. What documents USCIS will ask (if any) to re-submit? Perhaps I can start this process right now, for instance medical, to have it on hand when they will ask for it again?
My PD is March 2006 under EB-3 ROW. When I can expect my PD to be current?

Breaking News:
Some Indians are getting NVC fee notices with PD of June 2008.
Just as what I analyzed yesterday:
1. NVC sent fee notices to PD of 2007 after VB release in April
2. NVC sent fee notices to PD of April 2008 after VB release in May
3. NVC are sending fee notices to PD of June 2008 after VB release in June
It's just like what I predicted. DOS updates NVC on a monthly basis. I think
the spillover is much more than their originial estimation. We are going to
see significant movement in this summer.
I have my I485 pending since July 07. Would this fee apply to me as well?
Have they filed for I-485? Please let me know.

In the past, the NVC would typically send out the free notices a few months before the priority date is current. However, just because the NVC has sent these notices does not mean that visas are available soon. A visa can only be issued if the priority date is current. One has to reply to the fee notices within a year or they will terminate the cases, if people don’t respond.

DOS decision is never based on USCIS revenue generation as we all know they dont even see a dime of the application fee. Concerning USCIS, logically speaking all they have to do is wait for 6 more months to generate revenue after DOS will move dates in Q2. USCIS is already too backlogged with EB1 and EB2-ROW cases. IMHO, they are not in position to increase the backlog any more.
Do you know if you are documentarily qualfied?
You should get interview within few months after getting current. Please call NVC or check with your local consulate about this.
All I can say is that receipt of NVC visa bill by many applicants is nothing but portends good fortune in my opinion.

I need you guidance; I’m working for company A, possibly, I’ll get an offer from Company B. Company A have filed my H1-B extension (after 6 year based on I-140 approval). H1-B extension is in pending status with RFE.
Can I transfer my H1-B to Company B?? Please answer this question because it'll be very important to know so that i can plan my next steps.

You can transfer your H1 to company B while the initial petition is still pending. You need to make sure that the transfer application is filed before you recieve the decision on RFE on the initial petition. It will be better if you ask your new empolyer to do premium processing so that you get the result quickly. I am also of opinion that your current employer should not withdraw the i-140 for all this to happen.
I am not an expert and please take this as my opinion and not legal advise. Consult your attorney before you make any decisions.
