March 2012 Visa Bulletin Predictions - EB Category

March 2012 Visa Bulletin will be the third bulletin for Q2 - FY 2012.  Here is the prediction for March 2012 Visa Bulletin. We should see following movements in each category as long as USCIS/DOS would use visa numbers for each category as per statutory allocations.


March 2012 Visa Bulletin Predictions
  • EB3- China could advance to 22 December 2004
  • EB3 – ROW, EB3-Philippines, and EB3-Mexico could advance to 15 March 2006. EB3-ROW-M-P is still marching towards 8th August 2006 for current FY 2012.
  • EB2 will be current for ROW, Mexico and Philippines.
  • EB3-India could advance to 01 September 2002.
  • EB2-India and EB2-China could see 2 months- 6 months movement in coming bulletin. This may be last movement before cut-off date will stall until May Visa Bulletin. Dates may retrogress in May-June visa bulletin. Current data suggests retrogression will be reasonable around October 2008 or later. This may change with sudden increase in demand during later part of the year. Less retrogression may mean some rapid movement into late 2010 and early 2011 in FY 2013. 
At this time, everyone filed in November-December 2011 should expect GC within USCIS suggested processing times. October 2011 applicants have already started seeing approvals.

What is the suggested processing times for TSC? And does TSC control the numbers of approvals each month or process all the AOS and then let the approvals wait for visa allocations?

If there are chances of rapid movement in FYI 2013 then wouldn't they go for 1 yr movement now so that CO has easy 2013? When does CO's term end?

My friend you and everyone else has been underestimating the demand destruction that has taken place b/c of the Great Recession. This is the reason why the dates are advancing so rapidly - estimating movement based on PERMs filed is inappropriate b/c the number of PERMs filed far exceed the number of people that are qualified to obtain GCs right now.

My guess is that there will be no retrogression - the dates may stall but no retrogression.

What are the chances of EB2 India Sep 2010 getting current in the near future? As per my lawyer friend he guess either they will get Sep 2010 by next bulletin or max Jun 2010. After that there will be no moment until Oct 2012. After that the movement will be there by atleast 3 to 6 months. so Sep 2010 could be current max by Oct 2012. What is your guess? Again in your Predictions you have shown China has Mar 2010 and India is Jun 2010. In reality there are very less perm applications from China as compare to India. Dates are moving fast because of less filing from China in 2008, 2009 and 2010 comapre to India. What is your opnion?

AAA, its not Mar2010 for India and Jun 2010 for China. it should be read as PD for EB2-IC (India and China) might be anywhere between March 2010 and June 2010

Friend, I think no one can actually estimate the demand destruction due to various reasons. Even Mr. CO is having a hard time with this. Only time can give the true picture. Please keep in mind that all these estimations are pure educated guess based on calculations done on available data. Retrogression or no retrogression....lets all hope for the best for all categories.

Last 3-4 Visa Bulletins have created environment of great hope for people like me who have PD of Mid (May) 2011 (EB2IC).

However with no expertise to understand, analyze and extrapolate the data and news wonder if we would be able to get the EAD in next one year from now ....

Sorry I still had 2-5 months in my mind from previous estimation while doing that table but please read it as 2-6 months ie 1 Mar 10 - 1 Jul 10. good luck guys.

k.sh, I am no expert. But from my understanding initially HR3012 will be help India and China whose PDs are way behind ROW reach the same dates as Mexico, Philippines and ROW. Once this is achieved, there will be a common PD for all. From this point on, PDs for all move together based on FIFO. The intention of HR3012 is to have a common PD for each of EB categories (EB1, EB2, EB3, EB4, EB5). But, there is a reservation of visas that must be allocated to countries other than India and China. Only if these numbers are not completely used by them, can they be passed on to India and China.

The U.S. Department of State (DOS) Visa Office has confirmed that EB2 priority dates will advance again in the March 2012 Visa Bulletin. The exact amount of forward movement is not yet known, as it largely depends upon case filing rates. The DOS projects that the EB2 cutoff dates will move by at least a few months in March 2012. The DOS estimates that an advance of as much as six months could occur. They stated that it is unlikely that the dates will advance by a full year. Hi Sonam,

EB3 – ROW could advance to 15 March 2006 in the upcoming Feb 2012 Visa Bulletin. Overall it is expected to reach 8th August 2006 cut off date by the end of current FY 2012 i.e Spetember 2012 Visa Bulletin.

EB3 India on the other hand could reach upto 1st September, 2002 and will continue to move by 1-2 weeks in every Visa Bulletin for this fiscal year.

Here is an update from our attorney friend.

"With respect to EB2 there is nothing more that our law firm knows at this time than that was posted by AILA based on last meeting with DOS Visa Control Office Chief. This is my own conclusion that dates will move atleast 6 months. Infact I would not be surprised if it will move more than that. 9-10 months is very much likely. Thanks to USCIS for not processing cases effectively and constantly falling behind. Recently released processing times would definitely send some chills down DOS Chiefs spine. Increase in processing time means that DOS cannot wait until April visa bulletin to get demand for this year. It has to be this coming month. Doing rapid movement will not only ensure enough demand for USCIS but will also make sure significant applications are ready at National Visa Center to process at consulates abroad for summer. Straight forward cases at USCIS will see easy approvals this summer. USCIS will rely on low hanging fruits to reach their processing goals.

EB3 category will move slow but steady as suggested in February visa bulletin"

It means that USCIS will approve all the simple case regardless of I-485 and PD before retrogression. Complicated cases need supervisor review which add additional processing times. In past USCIS has always relied on pre-adjudicated cases to process wnough applications. This is first year after many where there will be no pre-adjudicated cases. That is the reason we are seeing slowing of processing times.

Can you define 'simple case' as you mentioned? Is someone with US Masters in STEM field working fulltime a simple case? So it means someone with PD Jan2010 can get GC before PD Jan2009?

Definition of simple case for an USCIS adjusicator is

a) It is completed in all respect. He does not have to go looking for information in the system.
b) Case where Alien Number file is already generated and available to pull. This file tells all the record when an applicant last entered in US. Records about status maintain since first entry to US.
c) Case where FP and BCIS check come complete early. Please note BCIS checks can take some time depending on your country and respective consulates.
d) Have clean Birth and Marraige Certificates. Adjudicators depending upon experience would know about secondary evidence, others will ahve to send files to supervisor for review. Please note supervisor is a group leader of 5-10 adjudicators. More cases that will go to him, more it will take him time to approve.
d) Cases were employee currently resides in same state as PERM stated state makes things pretty easier. Any discrepancy requires seeing your EVL and current title. If you are not on site where are you. Anyone working at client site could require additional review. Simple case will be you crrently working with sponsored employer.
e) If your company is acquired, mergered or changed names, your company information is checked along http://www.dnb.com/ site. If they cannot find your company name in the list. More review is required. It may require calling your employer. If 180 days are past, you may receive RFE for new EVL.

These are jsut examples of complications which can increase processing times for a case. Anything that is straight forward will be approved by USCIS adjudicators wihout consulting with or sending it to supervisor for blessing.

Can you estimate a small range of processing time for my GC?

Do you think TSC will speed up processing and catch up with the national average time of 4 months?

Its a notification that goes to the people who opted for consular processing telling them to pay the fees for scheduling the interview outside of the US

it is sent to people who chose CP process for the last stage. instead of filling 485 when dates are current , they will go for consular processing(CP). most of the time NVC fee notifications is 6 months before the priority date will become current( i meant it can as early as 6 months, and can also be one month before)

Please give some advices to my case (EB2-C): PD 4/2007, I485 filed in July, 2007, case got current in Oct. 2011, made first SR on Nov.2, 2011, recived response saying under additional review and check back after 6 months. Did second SR on Jan.3, 2012, and was told by a second level officer that my case has been Pre-adjudicated, but under aditional review. Did congressman inquiry on Jan. 4, 2012, got response the third day after saying same as under additional review, not ready for final decision. Now 4 months passed since my case got current, still in status of Initial review online. Some said I have done whatever I could, now the only thing to do is just to wait.

Could you please give me some ideals, is my situation normal?

Is there anybody out here who has the similar PD and filing date, but is still waiting?

I have read somewhere sometime that fee notification is being sent in advance(several months before the expected currency of PD)so it is not a guarantee that pd will become current if fee notification is received.

you say that folks filed in Dec 2011 will get GC in USCIS suggested processing times (which I think would be 6 months).  Since PD is current now for all of 2009 people,  who will file in Jan-Feb 2012, when will they be able to get their GC you think? Would it likely role over into FY2013? Are we lookinag Dec 2012-Jan 2013 timeframe? would they have a similar approach to moving PDs in FY2013 as FY2012?

It all depends upon retrogression. If dates will retrogress up to 2008 then dates will not move until late 2013. In case it will retrogress to only 2009, dates may move again in March 2013 or before.

I see good approvals for October and few for November. You should receive GC in month or two. I would recommend taking Infopass to see status on your case. See If it is assigned to officer. Processing at TSC is random. I am currently seeing quite number of cases from July that were pending getting approved now. So it all depends upon how straight forward is your case and when it is assigned to officer.

Mention of One of the friend is always a suspicious statement. I do not know of anyone with this late PD receiving NVC. In case if this is true still it is too early. Last year we received NVC notices for October 2007 in May 2011 which became current in November 2007. If this is true then it will take atleast 6 months for such case to become current. We will wait and see if we will see more such notices. I can vouch for April 2010 case that receive NVC fee notice few weeks ago. That is the latest I know of.

You have done all you could. It seems case is waiting final decision depending upon some important review. Did you changed jobs after 2007. If so did you file AC21. Sometimes one congressman is more effective than other. Try other senator or congressman. These are normal situations. I sometime see 2007 cases which got current last summer still getting approved in December- Jan. so you are not alone. Take info pass ans see if you can get more information. Hang in my friend.

It all depends upon when and how much retrogression will happen. I believe few Jan feb cases will also be approved before retrogression will happen. But onece it will retrogress it depends where dates will really stall. Anyone before that can expect approvals. Dates may not move this much in FY 2013 if PD will retrogress into 2008. If dates will retrogress into 2009 then may be you can expect some movement in Q2 FY 2013.

Question, posed as a scenario-

PD current-> folks from Jan 2009 file - folks from June 2009 also file I485.

Once filed, June 2009 case proceeds faster with processing (ex. no RFE etc) and gets adjudicated first.

PD still current when it gets adjudicated.

Is it possible then that such as case (June 2009) with a later PD actually gets GC prior to the Jan 2009 case?

If so,  so long as PD is current beyond your date, does it matter how far beyond your date the current cut off is? I guess it does not.

So, so long as current date is beyond your PD, your relative date really has no meaning. Correct? After that point, it really just depends on how long your case takes to process.

thank you for the data. I will look at it see how much we can expect. There are atleast 18K EB2-IC cases pending until Jan 2009 (January VB Movement). On avrage EB2-C have  55 cases each month and EB2-I have 700 or so cases. I believe cases in later half of 2008 are from those who became current in January but may still be filing but we can expect on average 400-500 cases in later 2008 and whole 2009. That will bring numbers around 23K pending. So movement in next VB. 2010 is denser year compred to 2009, so we can see again 700-800 cases per month. I believe to reach 27-28K, 6 months movement will be sufficient. To keep things safe, may be more 3-4 month movement. I think current demand is enough for this year. Note EB1 has 15K pending cases and EB2 - 12K. At this rate spillover expected is around 18K-20K + 5.6K annual quota. So current demand will enough. It is possible that retrogression will not be immense if cases in later half of 2008 does not pick up in month of February.

Sorry this is rudimentary analysis based on numbers I have in mind. I have to go back check this again based on other data.

That is absolutely right, if your dates are current, PD has no meaning, USCIS SOP ask them to handle cases based on receipt date regardless of PD. Cleaner case will be approved before any complicated one.

Yes you still be safe it is approved. HR 3012 is still not up for consideration on floor yet although it is showing on the calendar. I believe it will go through few rounds of amendments before it is approved. I will not be surprised if it's effective (that too if it will pass) will be FY 2013.

My PD is Oct 2007 but AOS was filed only in Dec 2011 with TSC. We received our EAD/AP  approved a week back.  Do they process the GC approval based on PD or Receipt date? I am little concerned as we filed it in Dec although our PD was oct 2007.
Will we have a sure shot of getting GC in 2012.

My PD id Feb 28, 2006, EB 3- ROW. If HR 3012 passes the senate with Irish E3 amendments and then goes back to House, how much impact it may have on my case?

People are saying the bill may have some chances to pass before St. Patrick's Day (March 17, 2012). By then the April bulletin shoud also be out. My question is, can DOS revoke a bulletin after it is published?

I am in exact situation and case with TSC...Pd oct 2007 but filed on dec 1st...got ead n ap approvals...i got biometrics done but my wife did not get biometrics appointment yet...raised an sr request which said case has not come up for review...but we both got ead and ap approvals 2 days ago....can anyone tell me wat to do for her biometrics? Dear CM:You hit right on the target about Mar visa bulletin prediction.

My case was received by TSC on 11/1. Can you put some color how the processing time will move after the new visa bulletin?

Also I see TSC approved some Nov and Oct filings and few Dec filings from Trackitt. Its seems no logic and not following FIFO order. Can you explain why?

And finally when do you think my case can be processed by a VO?

I am July 2007 filer..EB3 ROW with PD 23 March 2006. Most likely I will be current in next VB and probably get approved sometime in April. My I140 was revoked back in 2009 Sep after I joined the new company . The USCIS sent RFE  to provide them new employment letter (AC21). I responded to the RFE with a new job employment letter with duties and all. Since 2009 Sept, the USCIS status shows they received it but decision is still pending. I renewed my EAD with no problem.

Now, I am little worried that they will send more RFEs and delay my approval process. If this HR3012 gets passed from senate, then I have no chance of getting approved in a couple of months.

I heard somewhere that most of the July 2007 cases are pre-adjudicated. If they had more RFEs or interview, they should have already done it? What are my chances? Any response will be appreciated.

Dear CM:Can you try to analyze the situation below?

Primary EB2 485 approved and so do the children's. Spouse filed as dependent RFE for additional info  Spouse has H4 since her entry to the country many years ago and never left since then.

What kind of additional info may trigger the RFE?

Priority date June 14, 2010.  Is any chance in next bulleting? Chances of retrogession is still possible? What about last year spillover has been utilized? How about spillover of 2012 utilization?

I am in exact situation as yours...I got my fingerprinting done in dec itself..But my wife did not get finger printing notice...any comments....Raised an SR and got a reply in mail that service request action is pending...what else can be don for my wifes biometrics appointment??

My son was born June 19, 1988.  Petition was filed under eb3 category, Philippines last Sept. 13, 2006 and Priority date is Sept. 11, 2006.  Can you pls calculate his CSPA age if my PD becomes current by November 2012?  Thank you....

As of now based on trackitt trend I believe we may have enough demand for this year but definitely DOS will want to keep some buffer, which may mean some movement next month and then later in the fiscal year around August-Sep 2012 if spillover received is as expected. We will know more around May-June VB where are we going with this whole trend.

EB2C unfortunately how USCIS proceeds the cases is unknown. Cases are approved randomly depending upon who picks up your case. This is my own observation in past few months (this can be absolutely wrong) but cases filed in first week of each month are approved quickly compared to others. This may be just fluke or IO assigned for first week cases is efficient and by the time he finishes his one batch other from next month is ready. But this is just based on observation, but fact is no specific pattern.

All you can do is raise SRs or take infopass and then continuously followup using senators. Just be patient, your approval should be around the corner. You will receive GC this year based on your PD.

It is difficult to say but with passing days it is getting difficult for the bill to pass as it is. More focus currently has shifted to E3 visa bill.

Yes you will be current in May visa bulletin and if your case is ready at NVC or pre-adjudicated at USCIS, you can expect approval soon.

USCIS will process based on the receipt date. This is as per their SOP. One of the exception is a need to coordinate actions with other branches of DHS, or with other agencies in order to meet common goals. Here common goals will be in case of imminent retrogression to process case before certain PD. During end of fiscal year it could be process EB1 and EB2 ROW cases before EB2-IC cases and so on.

"Generally, applications and petitions should be processed in the order in which they are received. Exceptions can, and should, be made for a number of different reasons, and sometimes those reasons may appear to conflict with one another. Reasons for prioritizing certain applications and petitions over others may relate to:


· A statutory requirement, such as the requirement that joint petitions for removal of conditions under the marriage fraud amendments be interviewed within 90 days of filing and adjudicated within 90 days of being interviewed ( section 216 of the Act), or that L-1 petitions be adjudicated within 30 days of filing (section 214(a)(2)(C) of the Act);


· USCIS -wide policy pertaining to the type of application or petition being filed, such as The USCIS Director's fiscal year priority that backlogs in a given type of application or petition be reduced to a specified level;


· Current events in the homeland of the applicant or beneficiary, such as a natural disaster or civil war;


· Imminent events which may effect the eligibility of the applicant or petitioner, such as the termination of a program whose duration is limited by statute or the "ageing out" of a dependent,


· A need to coordinate actions with other branches of DHS, or with other agencies in order to meet common goals


· To correct an injustice which may have occurred, or to prevent one which may be about to occur. "

DO not worry about HR 3012 for this year atleast. Even if it is passed it may not be effective until next year. It is too late for this year to use it.

Do not worry your case will be approved once you will become current. Month you are current you can open SR or congressional inquiry. I do not think HR 3012 will affect your approval in any way.

Additional info could be as simple as birth cert or marriage cert.

It could be possible but numbers wont be big enough but 1000-2000 near end of the year. Such number will only change expected movement date for this fiscal year only 2-3 weeks.

You might be current in next VB. Chances are 50%. USCIS are using visa numbers as available without any bound so far. So that means no extraneous spillover expected other than what is EB2-IC using now from EB1, EB2 ROW and EB5. May be few here and there based on reduction in demand alter in year.

Did you guys filed his I-485 in 2007? If so, you must be all set. Nothing to worry about as his CSPA age is locked. If not then you need to consider time when your I-140 was pending. Subtract that time from his age at Nov 2012 i.e 24 years 4 month. It should be less than 21 years and he should not be married.
