March 2012 Visa Bulletin will be the third bulletin for Q2 - FY 2012. Here is the prediction for March 2012 Visa Bulletin. We should see
following movements in each category as long as USCIS/DOS would use visa
numbers for each category as per statutory allocations.
March 2012 Visa Bulletin Predictions
- EB3- China could advance to 22 December 2004
- EB3 – ROW, EB3-Philippines, and EB3-Mexico could advance to 15
March 2006. EB3-ROW-M-P is still marching towards 8th August 2006 for current FY 2012.
- EB2 will be current for ROW, Mexico and Philippines.
- EB3-India could advance to 01 September 2002.
- EB2-India and EB2-China could see 2 months- 6 months movement in coming bulletin. This may be last movement before cut-off date will stall until May Visa Bulletin. Dates may retrogress in May-June visa bulletin. Current data suggests retrogression will be reasonable around October 2008 or later. This may change with sudden increase in demand during later part of the year. Less retrogression may mean some rapid movement into late 2010 and early 2011 in FY 2013.
At this time, everyone filed in November-December 2011
should expect GC within USCIS suggested processing times. October 2011
applicants have already started seeing approvals.

What is the suggested processing times for TSC? And does TSC control the numbers of approvals each month or process all the AOS and then let the approvals wait for visa allocations?

What are the chances of EB2 India Sep 2010 getting current in the near future? As per my lawyer friend he guess either they will get Sep 2010 by next bulletin or max Jun 2010. After that there will be no moment until Oct 2012. After that the movement will be there by atleast 3 to 6 months. so Sep 2010 could be current max by Oct 2012. What is your guess? Again in your Predictions you have shown China has Mar 2010 and India is Jun 2010. In reality there are very less perm applications from China as compare to India. Dates are moving fast because of less filing from China in 2008, 2009 and 2010 comapre to India. What is your opnion?

Last 3-4 Visa Bulletins have created environment of great hope for people like me who have PD of Mid (May) 2011 (EB2IC).
However with no expertise to understand, analyze and extrapolate the data and news wonder if we would be able to get the EAD in next one year from now ....

The U.S. Department of State (DOS) Visa Office has confirmed that EB2 priority dates will advance again in the March 2012 Visa Bulletin. The exact amount of forward movement is not yet known, as it largely depends upon case filing rates. The DOS projects that the EB2 cutoff dates will move by at least a few months in March 2012. The DOS estimates that an advance of as much as six months could occur. They stated that it is unlikely that the dates will advance by a full year. Updates on this important topic will be reported to MurthyDotCom and MurthyBulletin readers as reliable information becomes available.

MY PD is June 22 2010 EB2 India.When will my case be current?
EB3 – ROW could advance to 15 March 2006 in the upcoming Feb 2012 Visa Bulletin. Overall it is expected to reach 8th August 2006 cut off date by the end of current FY 2012 i.e Spetember 2012 Visa Bulletin.
EB3 India on the other hand could reach upto 1st September, 2002 and will continue to move by 1-2 weeks in every Visa Bulletin for this fiscal year.

"With respect to EB2 there is nothing more that our law firm knows at this time than that was posted by AILA based on last meeting with DOS Visa Control Office Chief. This is my own conclusion that dates will move atleast 6 months. Infact I would not be surprised if it will move more than that. 9-10 months is very much likely. Thanks to USCIS for not processing cases effectively and constantly falling behind. Recently released processing times would definitely send some chills down DOS Chiefs spine. Increase in processing time means that DOS cannot wait until April visa bulletin to get demand for this year. It has to be this coming month. Doing rapid movement will not only ensure enough demand for USCIS but will also make sure significant applications are ready at National Visa Center to process at consulates abroad for summer. Straight forward cases at USCIS will see easy approvals this summer. USCIS will rely on low hanging fruits to reach their processing goals.

Does that mean more employment based approvals vs family based?

a) It is completed in all respect. He does not have to go looking for information in the system.
b) Case where Alien Number file is already generated and available to pull. This file tells all the record when an applicant last entered in US. Records about status maintain since first entry to US.
c) Case where FP and BCIS check come complete early. Please note BCIS checks can take some time depending on your country and respective consulates.
d) Have clean Birth and Marraige Certificates. Adjudicators depending upon experience would know about secondary evidence, others will ahve to send files to supervisor for review. Please note supervisor is a group leader of 5-10 adjudicators. More cases that will go to him, more it will take him time to approve.
d) Cases were employee currently resides in same state as PERM stated state makes things pretty easier. Any discrepancy requires seeing your EVL and current title. If you are not on site where are you. Anyone working at client site could require additional review. Simple case will be you crrently working with sponsored employer.
e) If your company is acquired, mergered or changed names, your company information is checked along http://www.dnb.com/ site. If they cannot find your company name in the list. More review is required. It may require calling your employer. If 180 days are past, you may receive RFE for new EVL.
These are jsut examples of complications which can increase processing times for a case. Anything that is straight forward will be approved by USCIS adjudicators wihout consulting with or sending it to supervisor for blessing.

Please give some advices to my case (EB2-C): PD 4/2007, I485 filed in July, 2007, case got current in Oct. 2011, made first SR on Nov.2, 2011, recived response saying under additional review and check back after 6 months. Did second SR on Jan.3, 2012, and was told by a second level officer that my case has been Pre-adjudicated, but under aditional review. Did congressman inquiry on Jan. 4, 2012, got response the third day after saying same as under additional review, not ready for final decision. Now 4 months passed since my case got current, still in status of Initial review online. Some said I have done whatever I could, now the only thing to do is just to wait.
Could you please give me some ideals, is my situation normal?
Is there anybody out here who has the similar PD and filing date, but is still waiting?

you say that folks filed in Dec 2011 will get GC in USCIS suggested processing times (which I think would be 6 months). Since PD is current now for all of 2009 people, who will file in Jan-Feb 2012, when will they be able to get their GC you think? Would it likely role over into FY2013? Are we lookinag Dec 2012-Jan 2013 timeframe? would they have a similar approach to moving PDs in FY2013 as FY2012?

Question, posed as a scenario-
PD current-> folks from Jan 2009 file - folks from June 2009 also file I485.
Once filed, June 2009 case proceeds faster with processing (ex. no RFE etc) and gets adjudicated first.
PD still current when it gets adjudicated.
Is it possible then that such as case (June 2009) with a later PD actually gets GC prior to the Jan 2009 case?
If so, so long as PD is current beyond your date, does it matter how far beyond your date the current cut off is? I guess it does not.
So, so long as current date is beyond your PD, your relative date really has no meaning. Correct? After that point, it really just depends on how long your case takes to process.

My PD is Oct 2007 but AOS was filed only in Dec 2011 with TSC. We received our EAD/AP approved a week back. Do they process the GC approval based on PD or Receipt date? I am little concerned as we filed it in Dec although our PD was oct 2007.
Will we have a sure shot of getting GC in 2012.

My case was received by TSC on 11/1. Can you put some color how the processing time will move after the new visa bulletin?
Also I see TSC approved some Nov and Oct filings and few Dec filings from Trackitt. Its seems no logic and not following FIFO order. Can you explain why?

Now, I am little worried that they will send more RFEs and delay my approval process. If this HR3012 gets passed from senate, then I have no chance of getting approved in a couple of months.
I heard somewhere that most of the July 2007 cases are pre-adjudicated. If they had more RFEs or interview, they should have already done it? What are my chances? Any response will be appreciated.
Primary EB2 485 approved and so do the children's. Spouse filed as dependent RFE for additional info Spouse has H4 since her entry to the country many years ago and never left since then.

All you can do is raise SRs or take infopass and then continuously followup using senators. Just be patient, your approval should be around the corner. You will receive GC this year based on your PD.
