H1B FY 2010 Cap Count : June 19, 2009

Posted On Wednesday, June 24, 2009 by CM
As of June 19, 2009, approximately 44,500 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

Is there any deadline or timelimit to fill the petition, can someone still fill the petition.

I dont think 65k cap going to fill even in next two months as USCIS revoked also some of the petitions..
No there is no deadline to submitting H1B application for FY 2010 as long as visa numbers are available.

Just a note, July will bring a couple of changes in the foreign labor certification programs. Current online Labor Condition application filing (ETA 9035E) is scheduled to be disabled at the end of June. Accordingly, beginning from July 1, employers who file LCA for H-1B petition must use iCERT portal system. Most of the employers and lawyers are trying to learn this system and this may add some hurdles to getting Labor cleared. Approval can take a week or two with the new system. Nothing is clear on this yet.
