H1B FY 2011 - Still 1000 Visas Available under Regular Cap

AS of 31st December 2010, USCIS announced that atleast 1000 visa numbers are still available under Regular Cap Quota. Masters Quota has been reached. USCIS is still accepting application under Master's quota that will be counted towards regular cap. Regular Cap eligible petitioned received till date is 57,300

What do you mean at least 1000 visa numbers are available. I see that there are about 7,700 petitions available to reach 65,000. I am wondering if its a typo or if I am missing something. I understand that your statement is true either way but why was it stated that way. Just wondering. Thanks.

That is a very good question. For most of the applicants what matters is remaining 1000 visas from the quota that is available for use by regular applicants. Regular Cap will be reached once 58,200 application are received. 6,800 visa numbers will be reserved for Chile and Singapore residents under the Free Trade Agreements with these countries. However, according to a USCIS rule, the numbers which are unused by Chile and Singaporean residents during the previous fiscal year are required to be used in this fiscal year. So there may be more than 1000 visas still available. Number can go beyond 58,200 depending upon recapture of those visa numbers.
