Here is the prediction for May 2011 Visa Bulletin. We should see following movements in each category as long as USCIS/DOL would use visa numbers for each category as per statutory allocations.

Predictions

  • EB3- China could advance to 08 April 2004

  • EB3-Philippines could advance to 22 August 2005.

  • EB3-Mexico could advance to 15 August 2004.

  • EB3-ROW could advance to 22 August 2005.

  • EB2 will be current for ROW, Mexico and Philippines.

  • EB3-India could advance to 15 April 2002.

  • EB2-India would see movement till 15 December 2006 (based on EB1 spillover of 12000, half yearly EB2-demand and half-yearly unused EB4 and EB5 numbers).

  • EB2-China could advance to 15 December 2006.

This site appears to be the best among those addressing curiosity of those in queue.

Though it would be a long shot, can you hazard guessing what is the likely period EB2 India with PD Oct 2010 would become available? I am weighing some options - one being going back to follow rising economy there rather than being a captive worker here.
Thank you for your kind words. I would think that EB2 India with PD Oct 2010 will at least take 5 years or more if we assume that EB2-IC will receive 15000 spillover each year. Even EB3 to EB2 Porting is happening at a rate of 4-6K each year. Taking everything into account, I do not see your dates becoming current before 5 years.

With globalization, I would look into the options back at your home country if you think that you can get a job that would give similar job satisfaction based on your current education and work experience here in US. There is always a chance you could come back to US on a project as a manager/lead. I would wait until your I-140 is approved. Please ensure you complete at least 6 months after approval in current role. This way you will have current PD tied to your alien number. If later, you will come back to US, you can use your current I-140 approval to recapture PD. Good Luck.

We expect September 22, 2006 to be current around August or September 2011 visa bulletin. It depends upon spillover. IF we will ahead towards optimistic scenario then August and if towards realistic September.

I expect EB2-I PD 1st May 2007 will be current in FY 2012 around July 2012. But you never know if EB1 Demand and EB2 ROW demand is very less (which I do not expect, economy has really started picking up) and porting to be reasonable (~3K). You can be current this year, but chances are slim (30 -40%). I really hope you can make it this year. Good Luck.

EB-3 (India) PD June 2003 will not be current for next 5 years. But if we assume that atleast 2000 applicants with PD June 2003 are porting from EB3 to EB2 every year, you can be current in 2.5 years.

Somewhere around July 2013. It really depends upon how USCIS would handle post PD July 2007 cases. I would think that USCIS would open gates for few months at start of each fiscal year and then re-open for few moths during spillover season.

There are also some talks that USCIS would use I-140 cases to track post July 2007 cases. But with porting and job changes it is difficult to guess.

If we are lucky, USCIS will have a policy to pre-register I-485 cases in place by then. This will make things crystal clear and we could predict that any movement will only be seen in July when unused visa numbers will be available for spillover.

NJ - Chances are very less (20-30%) for this fiscal year. You would be current around July-September 2012 as per current predictions and I-485 inventory.

This is because cases were recently transferred back to USCIS from local offices (District Offices). Recently USCIS asked local offices to send back all the cases that were pre-adjudicated and were waiting for visa allocation. USCIS started taking this action in late December or early January this year. Usually case that needs additional scrutiny including interviews are usually transferred to a local office and hence are removed from pending inventory. When they come back to USCIS National Service Center (TSC and NSC in this case) are counted back.

Other than this, there are always Consular Processing (CP) cases (though small in number) which are added to I-485 pending inventory as and when dates would become current for these PDs. I have seen this very common among three nations i.e. Mexico, China and Philippines.

Above two factors could always cause inventory to increase from report to report.

I think your PD October 22 2004 would be current around December'11-February'12. Good Luck.

I think it will take you atleast 6 year before you will be current. Somewhere around January 2017. Earliest could be around Sep 2016. Qualifying in EB2 for next job would really help you.

If EB2-I would progress to late Dec 06 or early Jan 07 this year, you would be current around Oct-Dec 2012 depending upon how would USCIS handle post July 2007 cases. But I think somewhere around that time frame.

If USCIS would have a policy to pre-register for I-485 in place by then, then you may have to wait till July 2013. Good Luck.

Not before 9 years for the best case. I would encourage you to look around for an EB2 job if you can qualify for one. EB3 to EB2 porting could bring some relief.

I would think somewhere around Feb-March 2012 for your PD based on current predictions. I hope you will find this information helpful.

I understand your plight after waiting for so long. USCIS is so far using around 2000-2100 visa numbers every month for ROW. Statutorily they can use 2400. So there is still hope that you can make it this Fiscal Year. Hopefully next week's I-485 inventory would shed some more light.

This is good news. Like we always said that EB1 and EB2-ROW demand could be big driver for this years EB2-IC movement. OH law firm suggests that there are 12000 unused visa numbers available since October 2010. If that is true then we can see movement upto July-August 2006 in coming bulletins well before later spillover would kick in. I do not think all unused numbers will be allocated in May bulletin but we would see some movement in EB2-IC by few weeks. Movement to July 2006 before spillover will be a great plus.

EB2-India March 2010 wil take atleast take 4 years to be current assuming EB2-IC will receive 15000 spillover each year.
I was expecting it to be current this year but how demand data is not showing any reduction month after month it suggests that there are lot of CP cases for EB3- China.

I would expect it be current for sure by February 2012. If demand would not increase chances are before that.

Your PD should be current by March-April 2013.

If Father has (I assume since I-824 was filed and approved) already filed I-485 for your son and his status is AOS, he is protected by Child Status Protection Act (CSPA) and he will receive his green card no matter how long it takes USCIS to adjudicate his application. That is as long as he remains unmarried. If he gets married before getting his green card he loses that protection.

Assuming you are EB2-I with PD June 2009, based on current PERM data we think you can be current in July 2014 as long as EB2-IC would continue to receive 15000 unused visa numbers every year.

Based on current data available and extrapolation of PERM data for ROW for FY 2008, I would expect you to be current by April 2013. This may change as and when dates would progress beyond PD July 2007 for EB3-ROW. Add +/- 6-8 months.

EB3-Philippines with a PD of August 10, 2005 should be current for May visa bulletin. EB3-P currently has potential to go far beyond 22nd Aug 2005 based on current demand. But it will not progress much because statutory limits does not allow EB3-P to have dates set beyond that of EB3-ROW. So for few coming months EB3-ROW and EB3-P will go hand in hand. It totally depends how much EB3-ROW would move in May Visa bulletin. We expect it to move at least to 15th August 2005 and best case to 22nd August 2005. So in any case you will be current.

Somewhere around June-July 2013. Best case will be in first quarter of FY 2013. It totally depends how USCIS would handle post July 2007 cases. If they will do in a controlled manner during first quarter you could be current in Oct-Dec 12. Else wait for spillover in Jul-2013
You have very good chances for this coming month's visa bulletin. If not then for sure in June visa bulletin. Please note that you can only file for I-485 when dates have moved to 22 August 2005 and not when dates are at 15 August 2005. Cheers

EB-2 Visa Availability – Charlie Oppenheim, Chief, Immigrant Visa Control and Reporting Division, U.S. Department of State, informed AILA of a dramatic reduction in the use of EB-1 numbers. He stated:

“[US]CIS says they have seen a decline in filings, and does not expect a change in the number use pattern. Therefore, this decline in EB-1 number use will allow me to begin having those ‘otherwise unused’ numbers drop down and be available for use in the EB-2 category. Based on current indications, that would mean that at least 12,000 additional numbers will be available to the EB-2 category. This situation will allow me to advance the India EB-2 cut-off date for May. The reason being that all ‘otherwise unused’ numbers are provided strictly in priority date order, and the India demand has the largest concentration of early dates.”

According to our calculations, EB-2 priority dates for India and China may advance not just weeks or months, but years!

This is wishful thinking. Dates will not advance by years. There are at least 37000 EB2-IC cases pending before July 2007 and EB3-EB2 porting are other numbers that will be added as date progress, there is no way date will progress beyond October 2007 even in most optimistic scenario. Yes, dates could become current for a while but I do not think USCIS would repeat July 2007 fiasco. They will rather move dates in more controlled manner.

@Rohit You should be current by Sep 2011 unless we would progress towards worst-case scenario.
In each case it will at least take 5-6 years.

Just a little bit more
There is no possibility of having any spillover from EB2 to EB3-P for longtime. If any spillover will happen it will first go to EB3-ROW until they will become current.

Most probably Next bulletin. If not then in June -July for sure.

You should have PERM advertised job or job that has at least 50% similar job description, day your I-485 is approved. In some pre-adjudicated cases, you will not get an interview and your case will be approved. But you are expected to have similar job on the day green card is approved and you should continue working for the employer atleast for 6 or more months.

Even if you get a GC without having a job, this could be again come up during naturalization.

I would think somewhere in first quarter of FY 2012 or July-2012. It totally depends how much movement EB2-IC will see this fiscal year.
Chances for tomorrow are very slim. With government shutdown happening, VB and Immigration is last thing on anyone's mind. Employees at DOS must be more worried about furloughs, shutdown procedures and non-paid time out of work. Worst shutdown that has ever happened in US was for 21 days. Hopefully this will be taken care in few days. Let's see

We should remember that this is an unusual visa bulletin which is going to progres dates optimistically for EB2-IC. Some kind of communication has to happen between USCIS and DOS before they can come up with PD cut-off for these categories. With Government shutdown looming it is very unlikely that employees will be completing any communication in timely manner. There is no vested interest here. Visa bulletin will come out next week if shutdown is prevailed by end of today else we have to wait until government will re-open.

That prediction was on March 23 when we had no news about expected 12000 unused visa number spillover. Our May prediction was updated on 29th March based on new news.

Right now we are back to square one. Sep 2006 should be current around Aug- Sep 2011. Best case July 2011.

I heard that most of the LCs are getting audited and that it is taking 2 years for LC approval if it is audited and ~1 year if it is not audited? Based on this it doesn't look like a good decision to change employers now? What is your advice?

using the website calculator, you have to wait for 1 year and 3 months more counting from jan 5 2011,that is 11 months more to wait,good for you ur almost there, me,4 more years to wait, hoping there'll be some changes on the movements,goodluck!
