When will I get my Green Card? - Green Card Calculator for EB category

If you ever wondered "When will I get my Green Card?", here is the 'Green Card' calculator for Employment- Based category. As per recent data released by USCIS on May 26th, 2011 on EB I-485 inventory this is a calculation that tells an individal how many I-485 applicants are there before them in the queue under their filed preference category. Beyond this, calculations are extended to predict how many years will it take an individual to receive a green card from current date (as per GMT).

Data beyond July 2007

Data beyond July 2007 is segregated from PERM data with respective to 'Priority Date'. To segregate EB2 and EB3, PWD minimum salary was used as a basis instead of assumption of 50:50. Ratio 50:50 do not holds true for many countries. Please see table below, which outlines PERM distribution for EB2 and EB3 for different countries.
Spillover Estimation - System will recommend spillover that we expect to receive in coming years for each country and category . EB2-India & China - PERM distribution for different priority date in EB2 - India and China was calculated. This distribution will control how spillover will be distributed among EB2-IC as dates will progress for different Priority Dates. System would try to average the Spillover among EB2-India and China in such a way that number of years required to reach similar PDs are as close as possible. For each fiscal year, system assumes following spillover.

In general distribution of EB2-IC PERM Ratio for different PD year is as shown below. In general, waiting time for Indian nationals in EB2 and EB3 category looks terrible. Since density of applicants per month in EB2-India is so high, that in long run EB2-China will not receive majority of spillover (couple hundred or few thousands). Since EB2 will not be cleared for atleast next 5-6 years, spillover expeccted to EB3 category is minimum. EB3-India will get some indirect- spillover each year due to EB3 to EB2 upgrades or porting which will cause queue to clear faster than anticipated. Individuals with PD close to 2004 -2006 will see ample benefit of this every year. Apparently, if EB2-I will stop receiving spillover or receive minimum spillover in coming years, wait time for EB3-India and EB2-India will end up same. If you will note EB3-India has only 102k estimated demand vs. 165k for EB2-India for PD - March 2011. This whole ordeal is very depressing and visa recapture bill is only hope for EB community.

In addition, you can also put an assumption for a spillover that your category and country would receive every year and see how this changes the scenario. Please see assumptions below. Please ensure that you enter "User ENTERED" value exactly as shown in table below.

I-140 Conversion Rate

 This data is solely taken from published data on website - http://www.immigrationwatch.com/uscis-processing-statistics.html ,and is just tabulated and presented here in different format. We have updated our green calculator to include I-140 conversion rate based on this data, Green Calculator, thus will not assume 100% I-140 approval rate for approved PERMs . This conversion rate is only used for calculation for any cut-off dates which are beyond July 2007.  For any priority date which is after or on October of the particular year, calculator will use the percentage approval rate value from the next year, thus assuming PERM approval time of 90 days.
Tabulated list below also considered volume of applications received at NSC and TSC in order to arrive at average I-140 and I-485 approval percentage, and succesively used those values to calculate 'rolling successive percentage'. Green Card calculator will use 'rolling successive average' to arrive at reduced number of applicants before your priority date to calculate estimated wait time. System will recommend I-140 conversion rate for each priority date.
I-140 conversion rate is also an 'USER ENTERED' entry where you can input values in 'Percentage' only. For e.g. If you will assume percentage as '75', entered value should be '0.75' or '75%'.



Multiple PERM Factor
This is still ongoing effort and we are still looking into estimating reduction in demand due to multiple PERMs owned by an indiviudal and his/her spouse. Based on the poll that we have on our website, double filings within a family looks significant factor to estimate demand beyond July 2007 PD. As per our current poll status there are only 220 real PERMs out of 329 filed PERM that will contrubite to demand. This is around factor of 65%.  

System will recommend 'Multiple PERM factor' based on your country and category. Multiple PERM factor is also an 'USER ENTERED' entry where you can input values in 'Percentage' only.

PWMB - PWMB is taken care of in green card calculator. In general PWMB number for a PD month is added to the current inventory for the successive PD month. For e.g. if PWMB for EB3-ROW with PD Sep -2005 is '50' , this number is added in PD Oct-2005 inventory. This is done because that demand will not be realised until specific PD will become current. For EB2-India and China, PWMB is added to the following inventory assuming PD in coming visa bulletin will move in increments as stated in table below.EW - (Others) - In addition to other category it will aslo calculate number for applicants for EW (Others) category. Due to complication in calculation it cannot estimate wait time as of now. We will update it going forward.
It is assumed that 7% of the total annual EB Visa Numbers (140,000) are allocated to each of the four retrogressed countries while the remaining 72% visa numbers are available to the Rest of the World. Visa numbers allotment for EB4 and EB5 are considered separately.

F.A.Q. - Why GC calculator is estimating more wait time compared to last one?
a) Our OLD calculator was predicting PERM distribution of 50:50 between EB2 and EB3, which is not true for most of the categories. This ratio has changed when analyzing as per PWD data. General trend is posted above.

b) Earlier annual PERM data was NOT distributed as per Priority Date but was simply divided among each month assuming equal applications number. This is not true. Number of applications for each category is increased for PD 2008 and PD 2009 due to recent approvals of audit cases. Data now is strictly divided as per Priority date (with error of +/- 5 days). For each PERM approval family size is assumed 2.25. There may be many individuals with late PD 2010-PD 2011 who are single but by the time they will get green card, annual family size may increase.

c) Wait time has tremendously increased due to addition of People Who Missed the Boat (PWMB) during July 2007 fiasco. These numbers are significant for each country and category. See our earlier post regarding PWMB. For example numbers considering dependents are for EB3-ROW is 13000, and for EB2-I is 9500. These data are added to respective inventory and number of application prior 2007 has increased.

Factors a), b) and c) are major reason for seeing this whole big difference. But now GC calculator is real representation of wait time for PDs post July 2007.

d) Post PD 2007, when calculating some of the PERM approvals, some of the porting application may be repeated but again as most of us think upgrade demand is small, it should not be large factor.

Total Visa Available Annually - We assume that entire annual limit is available to each category as per statutory limit, but this may not be true as some of the countries do end up getting more than 7% visas than annual limit and other's less. In such case user can input number of visas , a country and a category is receiving as per current trend. Calculator assumes annual limit but this field is User ENTERED.

Consular Processing demand (CP) - System automatically assumes CP demand for different country and category. Users can also assume this demand as '0' or enter specific percentage (%). This field is User ENTERED.

PD becoming 'CURRENT' and "Green Card in Hand" time - System calculates time from today when you can expect to become current. In addition to this you can input current USCIS processing time to estimate "Green Card in hand" time. In general it is recommended that if your I-485 case is pre-adjudicated assume 1 month and if new filing assume 4-8 months. This field is User ENTERED.

Green Card Calculator was also fixed to remove some of the demand that is prior to current priority cut-off dates from the released inventory. One bug in the spillover calculation was also as pointed by one user.

Note : This calculator is estimating wait time assuming DOS will not make dates current for any category (unlikely). These are on average generic wait time, and actual time may vary on case to case basis.

FOR EB2-India and China - Please enter TOTAL Spillover EB2-IC will receive. System recommends Total Spillover based on above spillover assumptions.

This is a very good question, if there is a realistic chance. Other than regular emails from NVC about paying fees for visa for PDs upto June 2008, there is no real indication of such progress in visa bulletin. NVC is seen to send these emails atleast 8-9 months before dates will get current, but this is true for other countries where CP demand is high about 15-30% but for country like India, where demand is only 2-5% even a month or two in advance is enough to capture entire demand. If by any chance it will not progress to 2008, still there is a chance that such movement will be seen in Q3 of FY 2012 to build inventory for next years spillover because dates are expected to reach July 2007 this year (if we will receive spillover that we hope for.). Great question.

Hi CM,

I read previously on your blog where in you said the chances for EB2 I progressing to first quarter of 2008 is a possibility since someone mentioned that he got a visa bill mail from NVC. But your opinion here seem to change a bit. Now it looks like people with PD of June 2008 also got the visa bill mails, so you assume that visa bill may not basis for predicting the movement. Am i right?

Spillover of 1000 assumed in GC calculator is assuming porting for EB3-India before your PD that should reduce the inventory. It totally depends how many individual really ported when there PD were so close. Chances are less but not impossible. IN any case I expect you too be current in 6 months at most if your PD is last week of June.

I would port to EB2 after few years or not plan to settle in US unless you are fine with working with your current employer after current salary for few decades. One ray of hope is Rep Lofgren's new bill, but still EB3-India will take long long time. I am sorry for being blunt but that is reality.

I have a question- when i enter the chargebility, EB preference and PD it shows the time in which I will get GC. So if it shows 5 yrs, does it mean 5 yrs from PD or 5 yrs from today?

My family moved recently to the different address that I wrote in my documents that was submitted to the NVC. Do you think it will cause a delay on my papers to forward to US embassy if I will write now my attorney to change it with my present address? My pd is nov. 2005,eb3 phil.Hopefully it will be current next month.

If you have an attorney most likely he will get your interview information. You might not have to change address on file but you should consult your lawyer. Changing anything on the file will cause delay but if you have PD late in November 2005, you still have three months. Talk to your lawyer what will eh suggest.

Hello...I guess I am confused in how this new calculator works. The last time I entered my information on the old system, it told me that me GC would be available in about 2 and half years. now it is up to 5 years. Not sure what is going on. My PD is May 21 2009. What is the corrected estimated wait time? i am just finding it hard to follow all this information and getting confused.

What GC calculator predicts now is much closer to reality. Some stats about I-140 approval for each year will be added soon and that will reduce time by some percentage.

Rajiv it is one of those rounding things in excel. How calculation is worked out, it will show 5 months starting tomorrow. It is just that you checked it today if you would see it tomorrow, it will be 5 months. :)

Firstly, phenomenal analysis overall. Most in-depth I've seen on the internet.

Here are my thoughts on the likely dip in I-485 filings with PDs post July 2007, due to the recession. I think we are overall exaggerating the number of EB2 or EB3 - India/China applicants with PDs between July 2007 and December 2009 for several reasons. Below are all the effects of the recession. Most of these aren't addressed in your analysis.

1) People actually filing PERM since July 2007 (actually, summer 2008 through Jan 2010) would have dropped as companies decreased hiring, laid off workers or just stopped supporting green card applications. This is considered in your analysis through the PERM applications.
2) People who had already filed PERM but got laid off prior to applying for I140s, or prior to receiving I-140 approval (and the company withdrew the application). This is not considered in your analysis. Some of these folks would have found jobs elsewhere but would have had to apply for PERMs again with new PDs (so they are double counted in your calcs) and some of them would have left the country unable to find new jobs (so they are included in the analysis while they should actually be excluded).
3) People who received their I-140 approvals prior to getting laid off but were unable to find new jobs so they left for their home countries and did not return (so they are included in your calcs when they should be excluded). These people will probably be included by the DOS (or is it the USCIS?) when they calculate the demand data, but no I485 applications will be forthcoming, so they won't use up visa numbers.
4) People who received their I-140 approvals prior to getting laid off but found other jobs (either immediately or went back home and came back on a new H1B later on), so technically, they would have to file new PERMs but they get to keep their old PDs, so they are still double counted in the PERM #s.

Of this set, only 1) is included in your analysis.
2) exaggerates the number of PERM applicants (the 80% odd PERM to I-140 applicants only adjusts for denied I-140s, not for PERMS that don't even file for I-140s) - considering this would serve to improve the wait time for everbody still waiting.
3) will likely not affect the demand data that is used, since the USCIS has no way to know that these people will not apply for I-485s, but it will affect visa numbers used, so it will improve the wait time for everybody still waiting.
4) double counts the number of PERMs for these people, likely to benefit people in the queue after Dec 2009 (since the affected people will keep their PDs of between July 2007 and December 2009, the double counting is in their second PERM applications which will need to be eliminated from the analysis).

I haven't figured out a way to enumerate each of the categories above from 2) through 4). As a starting point, if we could find out how many people in white collar jobs lost their jobs during the recession, and what % of all white collar workers are H1-Bs, & what % of H1-Bs are EB2 or EB3 Indian/Chinese, you can start to figure out how many people could be on that list (1 through 4). If it turns out that the total number is immaterial (just a few hundreds), then you ought to ignore this in its entirity. However, if it turns out to be material, it may be a meaningful analysis. At the very least, I'm assuming that your predictions are a worst-case estimate only to be improved by the above analysis.

Let me know if you feel some of these are already included in your analysis, or if you want me to clarify some of my statements above.

Put you details in the calculator and do not look into Spillover part of the calculation. You should be current as per what GC calculator suggests.

Great points. I agree on every point you mentioned for 2) to 4) and that will definitely reduce the number of applicants but we have no easy way to segregate that data and get better estimate. As of now we only considered 1) and this will be worst case scenario. Actual wait times will be less than what GC calculator suggests if any of the points from 2) to 4) holds true. But I have no easy way to estimate it. If you have any recommendation please suggest. Looking at H1Bs may not be feasible due to lots of extension and new filings. We do not have any data on when employer would start GC for a new employer.

When talking about USCIS yes they will not have any good way to estimate and bulletin will always move more than expected every year after PD July 2007 and then retrogress in trial and error format. Dates what GC calculators estimates for getting current are not these dates when PD will move forward and retrogress but it assumes these are wait times when it will be current again after retrogression and then will never retrogress. After this estimate wait time, individual can add processing time in there to get green card in hand for sure.

Green Calculator is just a guideline for someone to plan their life in US or abroad based on educated guess.

Calculator is in this post itself. Just make sure your IE version and Excel is upto date. See note - To be able to use this feature you must be running "Excel 2003 or later and Internet Explorer"

August prediction was always there but to view it you had to send an email and request a password. Once bulletin was released, it was posted without using password.

With EB3 india jumping by 1 month to June 1 of 2002 in the last bulletin - does it effect your calculator? Any possibility it may cross June 1 2 of 2002 in the next bulletin ( due to any spillovers)?

Rajiv, i need to update calculator based on where dates will move by end of this September. But I will do that in August.

Coming back to EB3-I, I am very happy for this movement. I think without any spillover I expect PD for EB3-I to move to 8 to 15 June in next bulletin. If you are not current in next bulletin,. October bulletin should make you current.

As per inventory there are 1900 applicants after including CP demnd for EB3-P from November to end of February 2006. Allocation for EB3-P from next year is strictly going to be 233 monthly. So it may take another 8 months atleast for it to cross February. Once September bulletin is released we will clean up some past demand from calculator and update it based on fiscal year's movement.

Sorry but this makes no sense to me. My priority date is Dec 2010 (EB2-I). According to the demand data published by USCIS, there are only 10,000 people ahead of me. But your calculator says there are 80,000 people ahead of me. Hows that possible ?

Hi Ajay,

You are correct there are only 10k odd pending cases as per the published data. This relate to the pending I-485 applications only. Basically these are the applications filed during July 2007 when the dates became current. The 80k figure in GC calculator also include the applications which are due to be filed when the dates become current, meaning the candidates with PD after July 2007 till Dec 2010(which is your PD).

I wanted to thank you for this calculator. I discovered this a few months ago, and until then it was like finding one's way in the dark. I got my GC today. Your calculator did give me an estimate...which was very very useful. It was very correct also. I wrote down numbers going back from 120, and started marking down days since May. I came to US on Sep 15, 1995, and got GC today..so exactly 16 years. Thankyou so much ---- I hope this wait ends for all soon.

I recently found your page and estimating mine since last few months, and it looked pretty accurate to me.

I am porting from EB3 (Approved) to EB2 (I-140 in process).

Can you please estimate for EB-2 India, Nov 1, 2007.

Since Oct 2011 VB is out, will it still take 1 Year 4 Months?
or will it be current in next couple of months!!! Am super excited as the date is approaching... (and If it will be current in next 2 months than I would have to switch my I-140 to Premium Process)

For this date, the calculator says that there are 41,816 applications in EB2 India that may have filed ahead of Aug 2008. I'm trying to understand how that number is calculated.
I tried to find this number from another site:

It shows there are about 22536 applicants in EB2 India before Aug 2008
I also downloaded PERM data for 2007 and 2008 from:
http://www.flcdatacenter.com/CasePerm.aspx
It shows about 15,000 certified applications from India between Jul 07 and Aug 08. And about 38,000 certified applicants from all countries between Jul 07 and Aug 08.
I know I'm missing something and would be glad if you could point it out.

I am not sure how numbers are calculated at immigrationroad.com but I can tell you what we have done.

We have atleast 8k applicants until July 2007 and another 5000 (including dependents) has been considered as people who missed the boat during July 2007. Total numbers until July 2007 PD comes around 13000 (including dependents).

Now after July 2007 considering http://www.flcdatacenter.com, if you will sort application as per PD from August 2007 to August 2008 you will see 16420 applicants from EB2-India. To get this data you will need to check PERM data for (FY 2007- FY 2011) and check how many of these had PERM filed between August 2007 - August 2008 but were approved later due to audit or other delays. Once you get that number multiply it by 2.25 to include dependents and then multiply by 78% for I-140 to I-485 conversion. So 16420 PERM applications will convert into 28816 I-485s and then adding 13000 to it will bring it to around 41816. Now 28,816 how many will really convert into demand is not know yet but this gives us worst case realistic estimate.

No you should not have to wait as long as your dates are current. I see your dates are current. Is your CP or AOS case? Did you open a SR with USCIS if it is an AOS case just to check the status of your case?

Using Infopass you can go to local USCIS office and ask Immigration Officer about current status on your current case. Since you are current since long time they will be able to tell you why is taking so long.

Do you know why you are opposing? At least, did you understand what this bill is and who are the beneficiaries? Who so ever it will be, they are already here and, working, contributing to already drowning economy by paying taxes, spending on vacation, purchasing every week right from small stores to multi-chain super markets. At least, these people are contributing some thing by competing successfully by constantly upgrading with the skills that are demanded by today's companies.

I would have learned some thing from your post if you have mentioned at least one reason for your act...

Without HR 3012 , wait could be long. More than 8-9 years. If this employer is ready to file EB2 category, check and see if there is any one out there. With kind of experience you have now, I am sure you are easily eligible for EB2 now.

Estimator is outputting correct, it can really take that much time as long as we see continuous 3000 portings from EB3 to EB2 each year. Else wait can be long.

Calculator shows 7+years without spill over and 2+years with spillover.
Although PD is now current and GC is expected (per my company lawyer) to come in 6 months to 1 year.
Am I missing something?

Calculator does not assumes movement by DOS to build pipleline. It only takes into account PD that can take expect GC this year. You will eceive GC in 6 months as long as dates will not retrogress beyond your cut-off date before your approval.

So far to receive GC you have equal chances as any other January filed applications. Only if dates will retrogress beyond your date, you have to wait until August 2012 or beyond.

It can this summer or in early FY 2013. It all depends how clean is your case and who will be assigned officer to your case. With NSC you can be hopeful for early approval compared to TSC.

The law remains unclear on whether this is possible. Based on the language of the CSPA and USCIS's inclination to limit CSPA benefits as much as is possible, it is quite possible that one could lose enjoyment of a CSPA benefit under a different I-140 petition. It is wise to consult with an attorney for specific legal advice on how to proceed. You may be current in 2 years but then your daughter will lose all benefits if you will try to change to EB2. Please consult good lawyer. Personally I believe it is solely on USCIS IOs discretion. Lawyer can just suggest but cannot be sure.

Generally East coast case will go to TSC and West coast will go to NSC for I-485. East and west coast is generic term, you can see actual filing area based on your state on I-485 form. TSC and NSC handles most of the EB cases.

 CM: Are you taking 3000 portings in your calculation always? My Eb3 PD is Oct 2003. Your calculator says it will take 1 yr 10 months with 2500 spillover from other categories. Other wise it is about 4 Yr 10 months. Is this correct?

Hello CM: Your calculator is a very good effort.
PD-02-Oct-2003 India EB3. The way you are using the spillover by Eb2 upgrade is not convincing. For my PD how can I expect 2500 applications to be moving EB2 for PD between Aug 02 and Oct 03? Even 2500 upgrade every year for various PD is a big number. I looked at the inventory for the last 2 times and the change was just 77 cases in Eb3 -2003 inventory. I assume this is due to porting. IS there a way to justify the number 2500 porting every year? If this number is real, then PD's after say 2006 will get benefitted.  Thank you for your work.

You do not have to wait to be current to send your docs if it is consular processed case. At this point NVC should have issued you visa bill and request you to send these documents. If they have not then you should contact them. This is only valid for cases filed abroad and interviewed at consulates.
